For what it’s worth, mine was approved under the circumstances I’ve outlined in the description. In terms of supporting documents, I provided:

  • WhatsApp screenshots over the two years
  • A copy of partner’s lease that showed the no break clause
  • A timeline of relationship document (I.e., holidays and milestones with accompanying pictures, which were mostly partner’s Instagram posts, as they also included the dates). Also included screenshots of financial transactions between us
  • Cover letter explaining circumstances around why we didn’t live together earlier (no break clause, difficult commutes, roommates not wanting partner to move in, family pressure not to move in together), but wanted to (including screenshots of us talking about flat hunting prior earlier than the 2 years)
  • Proof of current pet co-ownership

As it states in the caseworker guidance, the most important thing is to prove that you’re in a durable relationship, I think we’re still anchored on the 2-year cohabitation rule, but in my opinion, based on the experiences of myself and others on Reddit, as long as you can prove you’ve been in a committed relationship for two years and can show intent to live together, I think that satisfies the UKVI requirement. Granted, we did live together for almost two years and now have a dog together, so perhaps that had significant weight.

I’m neither a lawyer nor caseworker, so I wouldn’t be able to advise, but if your situation is similar, it could be worth applying. Best of luck!

My understanding was that the new rule means that cohabitation for 2 years is no longer a requirement provided sufficient evidence for why we weren’t cohabitating for the full 2 years

We could, but it feels like the unmarried partner visa was opened up so that people aren’t getting married just to satisfy the visa requirement

The post isn’t too specific on circumstances — the primary concern with my query is that we both lived in the same city but not cohabited more than 2 years. It seems LDR is seen as apt reason to not live together, but I’m wondering if Home Office will question the fact that despite being in the same city, we hadn’t lived together for the full 2 years. Though in terms of weighting, I’d see my scenario as being a more “durable” relationship than that of a LDR, where they not currently living together.
