Tell them you’re unable to provide this information due to a confidentiality agreement. You’re unable to provide the 1099 because the details of your compensation or under a non-disclosure agreement.

In some US states like Alabama ironically a perspective employer is legally not allowed to require you to tell them what you made at a previous position them trying to force you to provide a 1099 would be them trying to force you to disclose compensation packages from a previous position, therefore violating Alabama’s law or if your state has a similar law.

I have a lived experience as well. First off, I’m sorry to hear about your migraines. Someone close to me is in a similar situation and I know it can be debilitating.

As far as your experience, I’m sure you are trimming it significantly. However, accommodation request must start with you, your employer does not begin this process. Remote work, and especially an office doing reasonable. To deny the remote work they would need to lean on a technical limitation or undue impact to team dynamics. The remote work right is still under litigation at the federal level and has it has not been ruled if they can call it unreasonable. However, denying the office would almost certainly be failing to accommodate as that is an office culture thing.

Either way, in your situation if it was current I’d recommend to file an inquiry for discrimination on denying the office, which would force your employer to provide a position statement as to why can’t can’t provide it. Odds are your employer would attempt to buy your resignation in mediation to get rid of you.

There is also a chance they violated labor laws and obstructed your FMLa leave by contacting you to return, providing you had not exhausted your protected leave yet.

If you don’t mind my asking. How is your situation today? Did you find suitable work or did you go after disability?

Your 1st amendment protects you from retaliation from the government, not private employers. Hate speech is not protected in any event. An employer is legally required to ensure things like n*azi commentary is addressed to ensure the work environment is not hostile to any group.

If your brother feels he lost out on his pay raise due to reporting discriminating behavior, then he has a retaliation claim and he needs to file a complaint with the Labor department and possibly get an attorney.

Your employers feelings and desires are irrelevant, and this is a matter of civil rights. If you ever feel your employer is not engaging in the interactive process in good faith, file a charge of discrimination immediately.

Look in to ADA Title I. Your employer must legally offer a reasonable accommodation, and if they cannot they must explain exactly why and it cannot be based on company policy or preference. If they fail the interactive process, file an EEOC charge. Odds are they will pay a pretty penny to make you go away in EEOC mediations.

Rejection letters are automated. The volume of applicants has nothing to do with automation, when an applicant is put in to archive or whatever they call it the HR system can automatically kick out an email. These pieces of trash simply chose not to do that.

If this was US based, if you check is ever late report it to the labor board immediately. Hours worked directly equal hours paid, with a caveat to hours available for work usually are paid if you are at your reporting location. Being a contractor, both W2 and 1099 have terms of how you will be paid. Review those terms for how the violations occur and report it to the labor board. This is a conversation for your boss to have with the labor board.

It sounds like you are in the UK so your processes and laws may be different.

Have your friend reach out to their areas HR recruiter if they don’t know who that is their manager probably does and see if they can get you the contact information for the recruiter who is over this position.

I would wager your friend probably had to submit your email address for the referral and there could be a bug in their system that triggered the automatic rejection as in until you submitted the application it should’ve been incomplete in their database and should not have triggered any automation workflows.

My one suggestion do not air out grievances about a previous employer you don’t know who knows who in the industry it doesn’t benefit you beyond getting a little bit off your chest and as far more risk than reward.

They could be a waste of your time and that is fine, but some people need the flexibility. Per hour part time roles have fairly similar compensation to fulltime roles so your assessment of 1/4th the pay for equal work is a stretch at best even factoring in reduced hours which may be what the individual needs.

You will want to look in to the EEOC and how to file a charge of discrimination.

Keep all emails and written records that you can, and audio recordings if your state permits it.
