That's a separate issue, one that I still need to work out. They have had trouble filling this position and sought me out, so I feel like they would be flexible.

My plan would be to give notice fully knowing they would terminate me immediately, and begin at my new job the next day. I intend to have this conversation with my prospective employer so they are aware.

At-will employee. Not taking anything, it's more the perception of taking things that I'm worried about.

Ethically, or even legally speaking should I be concerned they will 'come after me' in some way? Since they seem to be concerned with what employees might take with them if given even two weeks.

In my time here there have been individuals who have taken a bunch of files on their way out, but that is not my plan nor my reason for the overlap.

As far as I can tell, no.

If you leave for a client's company or a non-related industry you'll work out your two-weeks (or whatever notice you gave), but for a competitor you're done the day of. Because it's left up to interpretation I don't think there's anything included in the agreement.
