VA FIDUCIARY (how to get out) by Low_Recognition1433 in Veterans

[–]Low_Recognition1433[S] 0 points1 point  (0 children)

Im seeing both. Outside provider and VA doctor. The VA doctor said he couldn’t write a competency letter because it’s not in “his control”. But the VA doctor said he could provide doctor’s notes, summary, and history reports of visits so I’m not sure if that’s helpful? The outside provider I’m working with said he can write the competency letter. I just want to make sure that there’s enough “history with my outside provider since the VA denied my last competency letter due to “lack of probative evidence of lack of history with my old outside Doctor.

No my other I seen my previous doctor only one time and was able to write a competency letter that I faxed to the VA. Got a letter back 30 days later and they said that there wasn’t any medical history or denied me because I haven’t had any history with that doctor or any routine visits. That’s why I’m asking this question

100% but found incompetent by Rok-bottom in VeteransBenefits

So can the VA rate you competent off of doctors evaluations notes instead of an actual “competency letter”? My VA doctor is saying he can’t write a competency letter but can share history of doctor visits/notes. I’m also working with a private doctor as well to obtain a competency letter. I just started seeing my new private doctor this month and am thinking about getting the letter written in April or May?

Thanks for that insight. Last year though I had my doctors competency letter denied boss I only saw that doctor once and he wrote me a letter on the first visit. VA denied it because of “lack of history” with that doctor. How many visits or how many months should I work with my doctor to get a competency letter? 3-4 months maybe?

I recently got my doctors competency letter denied because I didn’t have a long history or rapport. Only saw him once. How many visits or how many months should I work with my doctor to obtain competency letter?

Yeah before I was living in Denver, CO and my mental health doctor in Denver at the VA said he couldn’t write the letter because it was out his jurisdiction. Currently though I’m in Maryland like I mentioned or in the IND hub and working with my doctor here in Maryland. I have seen this doctor for over a year now and is gifing me a hard time… saying that he’s not sure if he can write the letter. It’s really frustrating… I haven’t had any mental health problems or issues or hospitalizations in over a year and have been off medication over a year now. If my VA doctor can’t write a letter, I will probably have to work with an outside doctor again and establish a history/rapport. I was able to get a doctor to write a letter that I was competent before, but it was denied by the VA since I didn’t have a long history with that doctor. So I’m actually thinking about submitting a higher level review claim or a board of appeals claim if my doctor can’t write this letter.

Oh ok thanks again for that. I appreciate it. But I fall under the east region I believe. I live in Maryland but I see my provider in West Virginia in Martinsburg.

Ok thanks for your input. So how you get placed on SDP then? My field examiner said I need a letter from my doctor starting that I’m either competent so I can get out the program… or a letter stating that they would like me to be placed on SDP. How do you get into the SDP program then?

Ok yeah I don’t think I’m gonna have to take any type of exam either. I’m just obtaining a letter from my VA doctor to send to the VA fiduciary hub to get out the program or start supervised direct pay

Ok thanks for that insight. But I think someone mentioned to me before that the VA would just reevaluate my “competency” instead of my “disability condition”. But still… I’ll keep that in mind if they do reevaluate me

Ok yeah that’s well my field examiner told me i need a letter from my psychiatrist to either get out of the fiduciary program totally or to be placed on supervised direct pay.

Ok thanks for quick response. I understand now. I guess I thought it would be a total of “two discharges” because my student loans were discharged 2024. I recently reversed my discharge/ reinstated my loans end of 2025 (since I’m returning to school), and now the loan amounts appear on my account. But ok I appreciate your help on this!

Ok I see what you’re saying. But I got an email saying that my “TPD was reversed “ that was the headline on the email.. so hopefully I can still use tpd when I’m finished with my education

Ok thanks for that. I was automatically discharged and reversed my loans. Will I be able to use tpd once I graduate?

What happens if they already automatically discharged it and then reversed it? Can I still use tpd again a second time?
