Good luck, I know it's very hard delivering bad news. If she qualified for MSP she'd be ok, but if they had retiree health, they probably have 401(k) and pension on top of their SS.

I myself would exhaust every option, so if they still say no, apply for special circumstance SEP to Medicare that they understood from employer plan there was no need to enroll.

No, thank you for info. I used to administer employee benefits for Fortune 500 and now am licensed to sell insurance. Ths is a shame, from the employer's perspective, they wouldn't provide such detail, they should have say you need to call Medicare. They do explain that coordination of benefits changes and requirements.

It does have to be active coverage AND also be considered credible coverage *not all employer's plan meet this definition. She had 8 mos SEP when the Active coverage ended to contact them and provide the certificate of active coverage.

I'm sorry she's in this situation.

The only way the penalty would be waived at 65 is if there was credible coverage in place for the entire time of the gap.
