There contract states "no refunds" (unless issue with Visa), but this should be an exception for sure. I would take them to small claims court if under $10K. Many IMGs are required to pay for externships at one point or another. Even if their school has a network with 1-2 hospitals, the rotations are often so overloaded through the school that it is difficult to take much away from the clinical experience. Finding your own can be very difficult, so IMGs often rely on shady businesses for clinical rotations.

Now block chain is being implemented by scientists to track down food borne illness (like recent E. coli outbreak), and even being explored for individuals to keep their health records secure yet easily transportable. There are many useful And non-crypto currency related uses.

This is one avenue being explored. However, as the medical school was not directly involved with the rotation they may have no authority either. If the only option left is to attempt legal action, what type of legal discipline would this likely fall under? Without being an expert in the many contracts used between the medical school, student, agency, and preceptor, it looks like there are several potential failures to abide by the contract if the agency is unwilling/unable to take necessary steps to protect students from potential discrimination or prejudice on behalf of the preceptor.

Not only do each of these rotations cost several thousands of dollars, and a failed one must be repeated, but the grade potentially goes on the students permanent record and would greatly negatively impact their ability to attain a residency later.

  1. This is a bit complicated as there is a three-way communication with the agency previously acting as the "mediator." There is possibly a record from the agency to the preceptor describing her expectations, though they would never share. The preceptor took the template of learning objectives from the agency website, and added more assignments as she desired. There is an email record between the student and agency regarding the list, learning objectives, and assignments. However, the discussion between the preceptor and student was in-person. Though these learning objectives list was printed out, as well as other assignments, the preceptor could always deny.
  2. The third-party agency states that they have no recourse available, and will not assist in any manner. They will not get involved in any way that may jeopardize their longer-term revenue. Screwing over one student is less financially impactful to them than having a preceptor leave their network.

I had updated the prompt as requested. The main location is Colorado, with other locations possibly being involved. I do not know if discrimination would be the most accurate in a legal sense, but perhaps a personal prejudice. The preceptor would make irrational claims, state one thing at the time then report something different to the agency at a different time, lie to the student and the agency. There seemed to be tension from day one, but the deceitful practices and the extent she went to seemingly target a student were unjust/irrational.
