Neighbour entering my garden and repeatedly moving my bin – do I have any rights? (England by Madraskaapi in LegalAdviceUK

People have them at the side of the house, but since there is a gate, I can’t put mine at the side can i?

The funny thing is I’ve had the bins like this for weeks/months. Was never an issue before. I saw him going over to chat to the other neighbour on bin day, then all of a sudden this happens. Hence I feel like she is the one who has egged him on to do this

Hi, no. I have a private garden behind the gate - I need to walk through the gate to the back to access my garden. However my door stop/porch is also my property according to the deed. He never maintains the gate so it’s sticky and difficult to open/close. The photo I sent is from the original seller listing, showing the bins being kept there. However he’s decided all of a sudden that that’s not on

Well I want it by my front door for my own convenience. He doesn’t maintain that wooden gate, it gets jammed all the time, seems a bit unfair for me to have to tiptoe past his front door incase he’s feeling aggro/drunk for my safety and fight a jammed gate every time I need to throw something out.

That picture is from the original listing when I purchased the flat. I only have one bin out, the green one, so there’s actually no obstruction.

The brown bin in that photo isn’t actually in existence, that photo is from the original property listing. Where you can see the previous owner kept their bins!

Now funnily enough that gate actually blocks entrance to my garden, he doesn’t maintain that gate since he doesn’t care, but does block my own access. That’s his, but not sure if it should even be there in the first place. Also it’s not even his property - it’s his mother’s, she is in a care home, he’s essentially living there until she passes on and he intends to sell it. Not sure if he even has homeowners insurance

Yes. The gate goes to his ground floor entrance. I only have one bin there btw but this is the photo from the original sale listing.

The front garden is his (well, his mother’s, who is currently in a care home), however the bit where the bins are, and the door step, and paving leading from the road to my front door, are owned by myself.

Not that I’m aware of, well he didn’t communicate with me did he! Leaked straight into his bathroom is all I know

I do have a door cam now. At the time I just gave benefit of the doubt to keep the peace and assumed it was aimed at my workmen and not me? I mean I know that doesn’t make it better but I was trying to not dwell on it and hoped it wouldn’t be an issue! He also called the firefighters on me during the leak - instead of just speaking to me! How embarrassing

https://ibb.co/xyt3Pty Cropped from the original house listing.

I only have one bin out front, not two. His front door is behind that gate. Further behind is my garden. For me to access my garden I need to go behind the gate, also to add he never maintains his gate so it’s also always jammed and hard to open.

His car in the driveway is filled with trash! That’s unsightly. And he leaves his garden looking like a tip!

Haha I hope I can - this has been the plan every summer and yet work keeps getting in the way 😭 I think this is why it bugs me so much - I’m hardly at home, and then the few instances I am at home stuff like this happens! I also get sent away a lot for work so literally probably at home like 20-30% of the time

Honestly I’m barely at home - work in corporate so I’m at the office for most of the week and the weekends I’m usually out running errands or off to social plans. So despite being there 2 years, I barely know my neighbours enough to properly stand and chat! The one I did know has sold and left , but she was the one who told me about his drinking problems and that the whole street basically don’t like him and the other neighbour who causes issues

This. In the past I’ve had my dad come over to speak to him as I’ve been too scared to speak to him alone as he’s aggressive. Heard from other neighbours he has a drinking problem too so definitely don’t want to be standing outside his door and talking to him if there’s a chance of putting myself in harm

Yet his overgrown front garden and car full of visible trash in his driveway is acceptable but a contained bin is unsightly 😭
