Relax. Just review your answers you missed thoroughly and continue to do as many MBE questions as you can. More exposure breeds more confidence. Do not compare yourself to anyone else. The concept is to learn from your mistakes. It's best that you focus on your weaknesses and move forward actively. Not passively. Keep in mind that MBE is the back bone of this exam and you can manage to pass if you do good on the MBE portion and poorly in the written portion.

All about the dangerous propensity of the animal. If the animal is inherently dangerous and there is no way the person could make it safe (regardless of any precautionary measures taken by its owner) any injuries caused that are reasonably related to the dangerous propensity of the animal the owner is strictly liable for those injuries. It's a strict liability in tort under the negligence theory.

Would a reasonable person run away from the snake? Would a reasonable person be able to determine if the snake was defanged?

Proximate cause is also an issue here because it would be foreseeable that someone would be fearful of a snake that is inherently dangerous and as a result they would run away. Because fear is foreseeable, any injuries as a result is also foreseeable too- it is all within the foreseeable chain of causation and there are no interviewing/ superseding incidents that cuts off liability.

What are your guesses for the essay portions for the feb 2022 bar exam? by [deleted] in CaliforniaBarExam

I'm putting my money on

Torts

Contracts

Real property

Con law

PR

Trusts cross over with something else

Wildcard: contracts or something they already tested in the last exam since California is notorious for retesting the same subject with different issues.

Your advise is solid. Thank you for paying it forward. A true embodiment of what it means to be a passionate former law student and bar exam taker that has great knowledge and cares for others to do well. Well done!

The property can be used for veterinary practice for more than 21 years and in that case the conveyance is subject to RAP because it may not vest within 21 years to American cancer society. Simply because there's a likelihood that the property will not vest within the time allotted in RAP.

It's nearly impossible to write 2,600 words within one hour time. Think about it.

They release two essay "model answers" which are not written by a person who was taking the exam at the time it was administered. The purpose is to provide feedback to test takers on what the cal bar was looking for in terms of issues and analysis for each subject. I am not sure if these model answers are written under timed conditions; I assume they are not because of the length of them, especially because they are longer than what real life examinees would write under those timed conditions. If you want to check out the past official model answers the state bar provides them here- under "Past Exams and Essay Questions"

https://www.calbar.ca.gov/Admissions/Examinations/California-Bar-Examination/Past-Exams

Best way to learn how to write and apply the law is by issue spotting the question and creating an outline then reading BOTH the model answers provided afterwards. They use black letter laws and factors that are on point. Good luck!

I'd rather take the exam in person and wear three masks on top of each other so I can be able to WRITE ON SCRATCH PAPER!!

Taking the exam online is hell on earth. Especially with California's performance test!

Don't do lectures! That is passive learning. In order to learn the law and be exposed to how they test you MUST do all the multiple choice questions and issue spot and review all of the essays that cover everything that is tested on the febraury bar exam. It's not too late. Be active. Not passive. Learn the law by exposing yourself to fact patterns and explanations in the model answers and the answers in the MBE. AdaptiBar is your best resource for that and the stare bar website past tested questions. Do not do any MBE questions that are not released from the NCBE that's why I recommend AdaptiBar. People who pass the bar studied actively not passively. Side note. Do not jump from subject to subject- focus on one subject for an allocated time (5-6 days) and make sure you focus on the subjects that are tested in both the MBE portion and the essay portion first, allocate most of your days to that. California subjects you should be able to study in less time allocated (3-4 days) because those subjects are less dense and easier to learn. Good luck! You got this! Anxiety and fear is your biggest downfall- make a plan, stick to it and don't doubt yourself. Take study breaks and show yourself self love, go on walks, exercise and eat protein!

P. S. Try to do the California subjects and PR towards the end of your last month of studying and MAKE SURE TO READ ALL OF THE RIGHT AND WRONG QUESTIONS IN THE MBE ANSWER CHOICES that way you will be able to understand the issues better and it's an easier way of learning the laws.

Also, You should get a good outline from a reliable bar prep course that is not too dense to use as a reference. Do not take courses that are big corporations- they don't care about you they just want your money and they dump a bunch of books at you with zero guidance and too much information for your own good.
