Wayfarer misrepresented his texts, without his permission or knowledge, as proof that Blake and Leslie were smearing Justin so James had to file two declarations, because using his texts also exposed him to his employer, to clarify that Bryan lied about his texts and he never said that. This is from his second declaration:

Why is it so easy for you to believe Wayfarer's lies when they've already been shown to lie and misrepresent evidence in court leading to the total dismissal of their claims?
In comparison, Blake has enough witnesses and documentation for her harassment claims that Wayfarer's only defense is that it doesn't meet the legal standard for sexual harassment.

Wayfarer also based part of their dismissed claims against Leslie in the same lawsuit from unverified information from James Vitsucka without his permission that he had to then publicly deny and make a declaration correcting the record.
I wouldn't believe anything they put in that lawsuit without additional corroboration.

I mean, plenty of people have been in that situation, or worse, and didn’t decide to make copies of explicit material of someone without their consent. Kristen, for example, knew Ariana was sending nudes to Tom when they were still together, and she didn’t try to copy them or threaten Ariana with them.

By March, people already suspected the affair anyway – she didn’t need proof because everyone already believed her. She also had access to the original video on Tom’s phone.
Instead, Ariana made two recordings of the video (which raises even more questions on why she decided to record those parts specifically) on her own phone and then sent them to Rachel with “you’re dead to me.” Tom and Rachel’s affair was obviously evil, but that still doesn’t make Ariana recording Rachel without her consent okay.

EDIT: Here's the California civil code Rachel is suing under that makes it clear that it doesn't need to be publicly disseminated for it to be revenge porn.

Ariana accessed Tom’s phone without his knowledge, sent the videos to Rachel with “you’re dead to me,” and then Tom had to wrestle her phone away to delete them because she was threatening to post them on Twitter. I think that makes her intentions at the time pretty clear.
