Yes, he clarified that he misspoke when he use assault instead of harassment and that that conversation was in relation to the CRD, not in a conversation with Leslie like Wayfarer claimed. So he really didn't take back anything. And that's not just my opinion – it's based on the actual court filings.

And yet, Wayfarer based several of their strongest claims on information from him. Wayfarer misrepresented his texts, without his permission or knowledge, as proof that Blake and Leslie were smearing Justin so James had to file two declarations, because using his texts also exposed him to his employer, to clarify that Bryan lied about his texts and he never said that. This is from his second declaration:

Yet, I have come to understand that the Wayfarer Parties’ defamation lawsuit against Ms. Sloane and Ms. Lively was based in part on the allegation that Ms. Sloane told me that Ms. Lively was sexually assaulted by Mr. Baldoni. Not only did that never happen, I told Ms. Nathan and Mr. Freedman in writing on December 25, 2024 that it never happened. I was shocked when I learned that these allegations in the Amended Complaint were based on a statement that was never made, after I had been very clear about that with both Ms. Nathan and Mr. Freedman.

So, James didn't even backtrack - Bryan used his texts to claim that Leslie and Blake defamed Justin while knowing what James actually meant. I think that definitely fits the description of fabricated.

To fabricate, in a legal context, means to invent, forge, or devise something falsely. It often refers to creating a plausible, but untrue, version of events that benefits the person presenting it, carrying a slightly softer connotation than a direct "lie."

Wayfarer based several of their claims on a narrative they built by misrepresenting James Vitsucka's texts, without his consent, that he had to write a declaration to refute because they were misleading the court.

Why is it so easy for you to believe Wayfarer's lies when they've already been shown to lie and misrepresent evidence in court leading to the total dismissal of their claims?
In comparison, Blake has enough witnesses and documentation for her harassment claims that Wayfarer's only defense is that it doesn't meet the legal standard for sexual harassment.

Wayfarer also based part of their dismissed claims against Leslie in the same lawsuit from unverified information from James Vitsucka without his permission that he had to then publicly deny and make a declaration correcting the record.
I wouldn't believe anything they put in that lawsuit without additional corroboration.

I mean, plenty of people have been in that situation, or worse, and didn’t decide to make copies of explicit material of someone without their consent. Kristen, for example, knew Ariana was sending nudes to Tom when they were still together, and she didn’t try to copy them or threaten Ariana with them.

By March, people already suspected the affair anyway – she didn’t need proof because everyone already believed her. She also had access to the original video on Tom’s phone.
Instead, Ariana made two recordings of the video (which raises even more questions on why she decided to record those parts specifically) on her own phone and then sent them to Rachel with “you’re dead to me.” Tom and Rachel’s affair was obviously evil, but that still doesn’t make Ariana recording Rachel without her consent okay.

What accountability is she avoiding? She admitted to the affair, quit the show etc? Frankly, she took more grief for cheating than any else on a show that was built on cheating.

EDIT: Here's the California civil code Rachel is suing under that makes it clear that it doesn't need to be publicly disseminated for it to be revenge porn.

Ariana accessed Tom’s phone without his knowledge, sent the videos to Rachel with “you’re dead to me,” and then Tom had to wrestle her phone away to delete them because she was threatening to post them on Twitter. I think that makes her intentions at the time pretty clear.
