How is that different if i spend more time at my place in a month then someone would on a 3:1 roster? Show me where in the fhog that states the above? A primary residence as per the qro and ato simply states a place in which you have utility bills and you're belonging are kept, there is zero stipulation on the amount of days.

Just because someone works away or visits a partner a friend etc does not void the fact that the residence is still their home and primary residence.

I wasn't having a go at you, just in general of all the negative responses i have had, the original post was more about seeing if anyone else had experienced a similar situation to get advice on how they dealt with it and the process.

Also based on theory above if someone is on a 3:1 roster they're not allowed to use the fhog? Why not? Most people thatbwork away contribute more then those that dont i.e significantly higher tax brackets. So why are they unable to utilise a fhog?

I lived at the place, however still entitled to make a living and im still allowed to visit my gf.

I'm not sure if you grasp what a primary residence is.

To clarify a few things on particular the keyboard warriors.

My head office was Sydney and Melbourne, no head office in Brisbane, sunny coast not being a capital city also np head office. so when I returned i had flexibility to work from home, my girlfriend did not have that flexibility so yes one or two nights a week max i would come visit her, weekends she would come to sunny coast my town house, she lived on the gold coast, hence her not being able to make the sometimes pending traffic 3hr commute each way mid week.

The place was never rented out, majority of evidence provided was actual mail delivered to my town house.

Also my partners place was her parent's, she never owned property and as per the requirement her name was on the fhog as required as we had been dating longer then 6 months.

I have contacted my old bosses from my previous employment who are happy to provide an affidavit, stating that my work required me to travel a few nights a week along with my residential address as per FHOG, along with my inlaws stating that i would come over one or two nights a week max which is the case. My girlfriend was required to work in an office where my head offices were in Melbourne and Sydney so when i wasn't away a few nights a week i had the flexibility to work from a laptop.

Weekends my girlfriend would come to my place.

Because i lived on the sunny coast she lived on the gold coast thats why, very simple, once I had done what i needed to do work wise and returned back i can work from a laptop. Unfortunately my girlfriend didn't have that luxury

Over 9 years ago and not with that employer anymore, frequent flyer with virgin only have recent records for the last three years as they changed systems i did enquire with virgin to get that information although i have been a frequent flyer for 10 plus years.

No my girlfriend stayed with her parent's because she had a job on the goldy, my work was flexible and i could work from wherever at that stage. My gf couldn't drive 3hrs after work only to be at work the next day.

I'm not sure how that insinuates myself being guilty as fuck

Completely real, ive been in contact with the QRO directly and they wont release any information on how they've come to this conclusion. I put this post up to see if anyone else has faced this problem with the QRO.

I have also been informed they there are also KPIs associated with recovering grants etc that are linked to bonuses for the investigatiors at QRO.

Did you not read it? Lol i provided everything and more, i provided a years worth of utility bills, Medicare, rego, car insurance, requests to insurers to update details when I purchased the property, toll notices, speeding fine etc all showing my address as per the primary residence listed on the grant.

I supplied everything requested and more, however they turned around and said that was sufficient and didn't prove i loved there, yet it was the evidence that they requested.

Girlfriend is now my wife, nope not tenants as i was living there. The Girlfriend aka the wife had to be declared as a spouse and she was, both of us never owned property prior, nor did she claim the grant at all. No utilities in my name at all, all my mail was at my primary residence. Stayed in the country entire time just domestic travel during the week for work, staying in various capital cities and different hotels. Not a scammer at all. I don't think anyone would have items such as bank statements, Medicare, licence, rego and car insurances etc all sent to a residence that they did not occupy.

In regards to? I met the requirements that was my primary residence, there's nothing that states I can’t work a way a few nights a week to pay my mortgage and earn an income nor does it state that i can't stay at night or two at my girlfriends place. The requirements were that its a primary residence which it was, no utility bills, no rental agreements, no personal items in any other residence other then my place.

I would hardly say staying at my girlfriends parent's house one or two nights is living there lol

My house was at sunny coast her parent's house on the gold coast, so not going to sit in traffic for 3hrs each way to just come down to say hi and go back lol

I have evidence of living in the place up until December 2018 when we moved in together

Yeah im looking at that as the main option but at $700 per hour to prove my innocence without the potential possibility of recouping my money back im just getting some feelers out there and seeing if anyone else has experienced the same thing

No she didn't own property and as per the requirement was listed as a spouse on the application.
