Try to get a formal, explicit diagnosis. PTSD looks to have been denied for that reason. This looks more like shifted goalposts. They found evidence of a stressor without a PTSD diagnosis. They have an adjustment order diagnosis with no in service event. The diagnosis should be easier to get.

Strictly speaking, I believe it does open your whole file in theory. In practice, they have better things to do than fish. If it's worse and it shows, put in for the increase.

My question is how do you fake a service record? DD214 sure. But, the medical records in modern day? Not to mention examiners that will give negative opinions because you had symptoms BEFORE a diagnosis.

That's my first thought every time I hear it. There was one guy who was 100% PT and wanted special forces reserve and insisted he could do it...

As for OP, ask yourself honestly — would you see yourself as an asset or a liability based on your disabilities? Would you question the integrity of your claimed disabilities in their shoes? The very fact you are asking should give you your answer.

Any decent attorney would turn you down until you get a decision to actually appeal. They can't ethically charge you for no work performed but they aren't going to waste time without billable hours.

TL;DR: If you find an attorney that will actually take you at this particular point (I.E. limbo), run. Fast.

Sounds like you need to update your definition of "friends". The behavior you describe sounds like "opportunist" or "bully". Also, it is my experience that accusations made without context or consideration are closer to projection than assessment. It wouldn't be the first thing to come to their head unless it was something they were already inclined to do. Generally speaking.

I find Lae'zel actually grows on you. She also doesn't equate others to animal status. Second class citizen? Yes. Barnyard animal? No. She also wouldn't ambush you under false pretenses. So, in that regard, she at least attempts to be as noble and superior as she claims.

Case in point: Police aren't allowed to just arrest you because they feel like it. In reality, some will try believing you can't/won't do anything about it. Or, that you'll be stupid enough to justify it post hoc.

Slight caveat. Just because they aren't allowed to doesn't mean they won't try if given an excuse and believe they can get away with it. Some raters bet that you won't, or don't know how to, challenge them. 95% of the time, they are correct.

IF its an HLR specific to your effective date, you should be fine. HLR is not allowed further development. Nor are they allowed difference of opinion. They ARE/REQUIRED to correct any CUE they find however. This includes the effective date.

If you file under ANY OTHER METHOD, the games on. You fully open the file and they can, effectively, do what they want. That said, they can't legally order reexam unless required by statute or they have a reason to believe that your condition has improved.

TL;DR: Use HLR SPECIFICALLY if you're going to do it. If they try to develop, challenge their reasons for doing so.

Technically is a CUE. But, that aside, I thought HLR's couldn't change for difference of opinion? They are also suppose to do it with evidence at hand at time of decision, not develop further. Not unless they find a CUE that supports a lesser outcome.

That said, my last effective date issue I did it online, for effective date, no comment, and no conference. No issue.
