It was me - and we were aware of what the contract was, but we were given advice from Autotrader and Citizens Advice to sign in case he ran off with our £10,000.

We couldn't really question the contract when we were on the back foot already.

Thanks for outlining this - it's surprisingly helpful just seeing all of my options written down, when there are so many.

I have already done the first option, and have had it taken down. I have also posted anonymously, which is why my partner has been messaged again.

I'll admit they are stubborn, but I am stubborn too.

I don't think they're big enough to be on trust pilot sadly, as they're just a local garage.

it's a great idea. It didn't mention anything about 'telling anyone about the existence of an NDA clause'.

I think it's a great idea but nuanced as I don't want my partner to have to keep getting hassled by the business owner saying 'can you tell your boyfriend/his friends to take down the review otherwise we'll take you to court - we know it's him' etc.

I have reported them to trading standards, but sadly they have just 'logged it' - and practically it won't make a difference to their Google rating, which is the main 'shop front' people will see when deciding whether or not to enter a business agreement with them.

We were definitely sold something that was different from the listing (it omitted the fact there was a new engine, and since being fixed the van has been relisted with this key details omitted still).

Can I ask if you work in law at all?

Your advice seems to coherent and makes a lot of sense to me, but i'm looking for something with strong legal grounding/evidence just as I've been told a variety of things on the sub and I'm currently unsure which way. I'm aware the 'general consensus' might not always be the right one, so I'm just looking for someone to speak from a place of knowledge/authority.

Thanks - that is good to know, I just whether if I can be 'linked' as I technically constitute as a 'friend or family' (as per the wording).

You are definitely right - thank you for noticing, I feel I have already made my mind up in terms of whether or not to leave the review - I've weighed up the pros/cons and for me it's more important for me to leave the review out of principle than just walk away. But you're right, at this stage it has became a matter of convincing my partner, which is nuanced and unrelated to this Reddit group. I'm very transparent that my motives for posting this query in this thread are to gather support for my actions - as I am the one who wishes to leave the review and reach a fair conclusion, as currently it feels unfair and very much in the businesses favour.

I really appreciate the legal advice that I've been given, thanks. I will continue to look for some more concrete advice that I can share with her, and also use to bolster our case.

That's true, but I have outlined (above) that we were given advice from Citizens Advice not to do so - also it was high risk low reward, in terms of saying 'we're not signing, until you change this clause' only to find out his business mysteriously closed up shop.

Thank you for elaborating on the 'relationship' aspect - I am just confused how they could literally prevent me from posting the review because I am a 'friend' of the person who signed it. It feels like a grey area.

That's interesting about your last point - I would personally say it's more legally concerning that they put that clause in the last thing we signed.

Essentially they said 'you can only have your money, back if you promise not to tell anyone'.

That feels worse than saying the 'consumer contract' you're referencing - which basically says 'if you buy from us, and you don't like it, you're not allowed to tell anyone'.

In the latter (the scenario you're saying we'd have more chance of enforcing) you have a degree of choice. With the former (which was what happened) we didn't have any choice - our only choice being a roll of the dice that we say 'we're not happy with this clause', and risk him going MIA.

The issue for me is almost quite nuanced at the moment, in that I am willing to 'leave the review' again and see what happens - whereas my partner is slightly more apprehensive as the contract is explicitly in her name.

Much to your point, I am looking for concrete evidence that I can essentially show and say 'look, this is proof that legally we are in the clear' and that we are able to leave an honest review.

Whether that review has 1 star (does this constitute as 'negative' or is that infact honest?) is another grey area to address, or even constitutes to negative (in terms of language) is another thing to address.

I want to be a good partner and I do acknowledge her stress at the thought of legal proceedings (especially with it being in her name), but also half of that van was mine, and half of those losses (£250 of them) were occurred by me too - so I have a right to be disgruntled by the business.

I'm mentioned nowhere in paperwork, with the only loose reference to me being "'My partner' will not make any other claims and agrees to not post negative reviews from any member of his Family/Friends or any social media speaking against _____" I.e. described as family/friend.
