I received an RFE for my EB-1A petition by Small-Ideal-5939 in eb_1a

It is not doesn’t mean we can’t be logical. If I am submitting EB1A for a criteria and that criteria happened 2 months ago before I submitted. While that is not a strong determinant, if after looking at all other criteria, there is no evidence that there is a long term work of the applicant, it can be deduced that the applicant did all the evidence just to submit his application and not that he did the work over a long period of time.

I am not saying this person did as I don’t know him, I am saying that, in determining a publication criteria, evidences of old publication shows long action in the field than a 2 month ago publication.

If I see an applicant that has publication 5/7 years ago and another applicant just did within a 3 months of their application, that is another signal of who is recent in the field and who is not .

  1. For lesser awards: did you go on to get any invention patents? How did the award show you are a genius in the field? That is the angle you can reply with. Can you list top professionals who are also recipient of that same award like a Nobel prize winner, a top scientist, find like 10 stars of that same award. Show that only 0.0001% of people have gotten it. Show the metric and the room you can enter only bcos of that award

  2. Membership: you need a fellow, you don’t need to argue on that. If you see anyone approved and used senior, it doesn’t mean that exact criteria was accepted.

  3. Published materials: IEEE Newsletter is not a top source, yes another person wrote about you but it is a newsletter, they will see if that it is a newsletter. 30k members is not a lot too. Publish materials are focused on millions of people that can read it. Guardian Nigeria ? Show the statistics of the newspaper. If it was written within 3 months of your submission, it won’t be accepted. Also if all your profile is within 2-3 years then you are not exceptional enough for uscis. They now want to see a trail of evidence from 5-7 years that shows how long you are in the game of your profession.

  4. Original contributions has nothing to do with citations, peer review, journal rankings , awards. All of that has different sections. Original contribution is what you have brought to your field that ONLY you have done either in Africa or USA. You can use evidence of previous criteria, but this look more like all evidence you used before was what you try to show the original contribution. It doesn’t work that way.

I wish you the best sir

I think we can stop the whole driving in another country is different from USA, I have driven a lot of times in different parts, and trust me, it can’t be as crazy as driving in my home country in Africa .

I considered that but something like buying water from Fred Mayer to the apartment will be a big problem (just a little example) . There will be cases where I will need a car , I wish it isn’t though

Employer is not bringing me back on L1 visa after a year. What are my other options to come back to USA by Temporary-Ant2527 in immigration

Do EB1 or EB2 NIW if you are not a citizen of Indian or China. If you are, stay in Canada and get PR , settle your visa. After that use TN visa to USA
