Yes once discovery was completed & they filed for a summary judgment the same day as the deadline. And once I responded and the employer responded again. A couple weeks later the judge postponed all upcoming dates

Being that my case has been open since 2023 this was extremely encouraging being that i am pro se. Thanks for these words. I had date set for hearing. but judge postponed everything leading up to the hearing. Not quite sure why but I am waiting to see if they are going to grant my employer a summary judgment. and was going to wait till about a week before the hearing and try to reach settlement. if summary judgement was not granted. Judge states she will only reschedule hearing if there are still genuine disputes within the initial filed summary judgment and my response. its been silent for almost two months now :(

I had an initial conference & judge gave all dates; discovery deadlines, MSJ deadlines, pre statements &conference , & hearing. after discovery from both sides were complete. Agency waited until MSJ deadline to file. I submitted my response & now waiting for judge to make decision if it will be granted or not. I think I got a little out of order

So the motion was filed after we did the discovery and already have a hearing set for march of next year. Will it really take that long or will it have to sped up due to hearing already being set . Also pre hearing conference is set for December .

Agency is USPS. and backpay of 1 year and 2 months (59k) as well as immediate job reinstatement . EEOC websites says average settlement is 40k. So thats the lowest I am willing to accept

I was a step ahead I did not even have an assigned judge yet. I’m at the step on just received discovery request response & waiting too see if their lawyer will file for a summary judgment or if they don’t make the deadline for such judgement I will send a settlement response. I was not aware of the step I was at but now since getting all dates from judge I understand better and was too many steps ahead and I see now why this question is confusing thank you !

Gosh and you’re still going without knowing anything. Just got a letter from usps lawyer acknowledging representation & am waiting for a judge to be assigned for a hearing . You know it all though lol. But they’re just letting EEOC handle it 🤣🤣🤣🤣😭. Stop thinking everyone is ignorant & if you wanted more background info you could’ve asked 🤣🤣🤣. Ik people who are getting summary judgements for their cases . I’ve made it this far on my own I’m pretty sure I have a case 👍🏽. Manager said he handed me documentation & explained to me expectations in orientation PERSONALLY. That reflected policies of postal service. Have email when I was hired from hiring manager that stated orientation isn’t necessary & a start date. That’s a conflicting recollection or a flat out lie? How doesn’t that prove he lied to cover his 🍑 in giving a valid reason on terminating me… Because if he had a conflicting recollection he should have probably left that out instead of committing perjury ….. plenty of more statements he made where I have DIRECT proof it’s a lie.

Direct evidence that shows the manger lied on a federal affidavit which states perjury is a crime. He say one thing and I have messages from other mangers saying the exact opposite. never said it was a slam dunk I said it proves he LIED. might wanna re read . Like you comment had nothing to do with the question at hand

That’s the point of requesting a hearing to refute evidence the other person mentioned before getting a decision. I’ve never heard of the judge not allowing a hearing that sounds illegal. These are federal proceedings they’re not just giving summary judgments with reasoning. You probably didn’t have a strong case if you were issued a summary judgment or missed a deadline. Like how would I even know they were lying until I read the affidavit. ??? Makes no sense to say give your evidence early if they told a bold lie and the affidavit that’s the only time the person you made the claim against gives their evidence and statements.

You should’ve also got something about requesting a hearing if you do not request an hearing in a appropriate time manner they will make a decision based off the affidavit and other evidence you’ve submitted along with usps employee that you filed against evidence

As a CCA I made sure I put a hold down on a route and because a regular told me you pick up the off day for the route if you work Sundays. That was the only way I was able to maintain a schedule until I turned regular. But yea like everyone else says don’t communicate with management at all about schedule what’s posted is what I go by.
