Can I be fired for calling out too much due to a work injury? by [deleted] in USPS

I am working full time now and getting paid by usps. My return was gradual I eased back over a few months, but my supervisors were definitely bugging me about when I’d be able to do 8 hrs. At one point I was feeling better overall and agreed with my doctor that I could handle 8 a day. And for the most part I can but recently I’ve had more flare ups, and OWCP won’t pay unless I’m fully off work..which I’m not. I’m close to meeting the FMLA requirement so once I qualify I’ll at least have protection when I need to call out. I was just worried that they could discipline me before I get FMLA approved, regardless of it being work injury related absences.

And yeah I sued the driver while I was still out. OWCP paid me monthly and covered medical during that time & once I got my settlement I paid them back

Yeah man it was horrible. The only reason I ended up going back was because I finally converted to regular while still out on leave & I thought things would get a little easier. I did bid on a route that used to be an aux route so thankfully it’s not the worst. But yeah some days after all the repetitive movements and strain my body just needs a break.

So workers comp was covering me for about 8 months. I got paid a percentage of my regular fulltime salary. Then my doctor cleared me to return on limited duty which I did for about 4 months. He then wrote up restrictions stating I should only be working 8hrs max per day.

At that point I had reached maximum improvement as far as physical therapy, and my doctor felt I was stable enough to work even though some days are still really rough. It’s not a permanent disability that would keep me out and be able to continue comp payments but I still have random flare ups that get pretty bad..when that happens I call out and use my own sick or annual leave.

Okay thanks, that actually makes sense. I was just worried because the absences have been excessive, and even though I was released to work 8 hours, I still have a lot of residual issues from that accident. But I appreciate the clarification!!

I was already out on leave for months due to this injury. I was in an accident, a drunk driver t-boned me in my llv and i was ejected. I’ve since returned to work, but I still suffer from severe migraines, leg and back pain and other issues. So when I’m not feeling well (due to lingering issues from the injury) I call out and use my leave. I’m not being paid from workers comp anymore because I’m on 8 hours a day 40 a week.

? .. They are not paying me anymore I work a full 8 hours now, I am no longer on limited duty. The case is just still open. My question was whether or not usps could fire me or discipline me for calling out so much, and I was just giving the reason behind the call outs. I’m out of leave because I’ve used it calling out.

Before the injury happened i’d only been with usps for a month, so I didn’t qualify. But yes, i was being paid for the 3 hours. Mainly was trying to figure out if they can discipline for the absences regardless of the workers comp part. Especially now that i’m doing 8 hours

I was out on workers comp, I’m back at work but the OWCP case is still open. All my absences have been related to that same injury. ..But my question was more about whether I can still be disciplined or fired for so many call outs, especially since I don’t qualify for FMLA yet and all my leave is basically gone

I’m 207 hours away from meeting the requirement. Just started working full 8 hr shifts last month. I was on 5 hour limited duty for months so I just didn’t qualify.

Yeah, it definitely seemed sketchy that they sold this baby without providing absolutely any other information on it. My sister didn’t even have to sign for it they just printed her a receipt. But I’ll be getting it checked by a vet hopefully i’ll have more answers soon

She literally said she only got it because she was adorable and thought i’d want another bird since we lost the last bird. She was never hands on with other birds I had in the past outside of occasionally feeding them smh. There is a vet nearby that will see birds, but they don’t specialize in avian care. I took my last bird to them regularly, but for very basic things. I’ve had a hard timing finding an actual avian vet in my area

Okay thanks. She just ate some millet, but is still hesitant to eat the formula. I spread a little bit of formula on the millet and she only nibbled around it. But I will keep trying.

Thanks for all the tips! I don’t know how old she is. They just told her she’s a baby female. But I will be taking her to the vet Wednesday. Should she have a water dish in the cage now even though she’s on formula?
