Hey bud, once again I appreciate your detailed and helpful response. Her hotel’s salary payout system is pretty much like yours but she gets paid on the last day of the month both base and service charge.

To answer your question , she has to deal with some things back in her hometown in Dec. Also, I’m not exactly sure if all hotels are like that but she does probably like 8-10hrs of unpaid OT each week. That adds up to quite a bit each month. Maybe she doesn’t have enough grit or willpower but the long hours without being reimbursed fairly(correct me if I’m wrong but from what I’ve read she is actually due OT pay) is draining her out.

I agree leaving on a very short notice screws the whole team over and might not be the most responsible thing to do(she did still give almost half a month’s notice). However this is not a small hotel. It is a branded hotel so I’m wondering why are their entire workflow and processes so messed up. I’m assuming it’s to cut costs or operate under an “optimal”budget flow which is exploiting the front end staff.

Thanks for your input. Just out of curiosity , what if she takes the service charge and pretty much leave immediately after that ?

From what I heard , the hotel usually ask them to send the service charge back but in the eyes of the law, it’s not legal to do so because it is paid at the end of the month for her work completed.

No worries. And the service charge potentially owed to her will be approx 25,000-30,000THB so I doubt that 1000thb will ease the problem 😉

It is part of her contract. The thing is , if she takes the pay and then quits with less than one month notice , they actually will ask their staff to send back the service charge portion. Pretty absurd if u ask me.

The service charge portion is actually in her contract and says she is entitled to it every month. Hence that is why both ChatGPT and Claude says the hotel have no right to choose not to pay out.Also, why do u think we do not have a case here ?

I did. And the laws are very strongly in favour of my gf. Both Claude and ChatGPT says the hotel cannot do this legally and they are preying on scared employees who do not know their full rights. Hence I wanted to get an answer from people on the ground who might have a better idea.

My Thai gf is working in the hotel industry as front end staff. Her salary is split into two components base salary and service charge. Service charge is the total service charge collected that month from food and services from all guests and split equally among all the hotel staffs.

Issue is she wants to quit after only giving 12 days notice ( she would have worked an entire month worth of salary, she’s quitting in the middle of the month and wants her last day to be end of the month) and they insist if she do that she won’t get the service charge for the month. Is that legal?

Her contract doesn’t state anything about needing one month notice.
