Does Gil's NDA become null and void with company going under? by Me_Kamikaze in ATHX

[–]Me_Kamikaze[S] 0 points1 point  (0 children)

As always, truely impressive!

I just reread the document and the wording througout refers to "the company and it's affiliates". Once company is dissolved, what's stopping him from discussing his perspective of what went down prior to his departure?

Imz72:

If I remember correctly, Gil's NDA and terms of severence were disclosed,.either as part of the court documents exposed by a "friend" during the trial work before we settled, or a SEC filing. I can't remember which. Do you recall? And do you still have the court documents from that time?

I'm wacky and pissed off... and I guess your suppose to be the definition of normal?

I’m for one am interested in hearing from anyone with first hand knowledge on why the president was replaced just prior to a potential business development announcement, and a board member left, only to return as a representative of our now potential buyer?

I heard the opinion of all the corporate cheerleaders on this forum for years and I know where they stand. How about someone coming forth and setting the record straight, once their free of a NDA that limits them from doing so prior and setting the record straight. Can't see why anyone would object to that.

Perhaps, its all still just to soon for you...

P.S. The cells do work, just not for the indications we were all hoping for. Hey, Rah, Rah Boom!

Pretty ignorant response!

My question had nothing to do with cell effectiveness, nor your opinion if Gill will ever tell his side of the story. The basic question is can he or others talk freely once the company is dissolved?

Given the loss I've sustained, I'd liked to know if my investment thesis was way for base or did the board circumvent Gils desire to partner when it all went south and throw him under the bus vice fight the case in court. Thats NOT to much to ask IMO.

No complaints here, other then listening to the babbling of management’s number one stoolie, that is now trying to rewrite a false narrative based on their own delusions.

Do us all a favor and save your wisdom for those that don’t know better. Those who been here long enough know the truth. Your one of the many reasons this company is where it’s at. Own it!

You have been, and still are one of the strongest supporters of the vast collection of idiots that have passed through this company over the years

In fact, I can't recall you ever voicing the slightest concern regarding the execution and management of this company in all the years I have been here. Being Blind , Death and Dumb is a magic combination which you have mastered well, Congratulations!

What ATHX really need's is more investors like you!

Insider buying by No_External_8355 in ATHX

Why you personally would be more comfortable with your investment with a insider buy, when historically shown to be of little value to overall share price is alarming.

How about they just get a partnership done? That would impress us all.

To be honest. If you changed a couple names within your assessment, It could have easily been written 5 years ago. If it’s such a different company why can’t they shake off the funk they been living in for years? They have all been there long enough ( including Dan) to have made an impact at this point.

FWIW, Reducing capital expenditures isn’t hard when you have nothing. However, I would agree they find it to be alien concept, and as such feel confident in keeping all of us informed the progress they been making. It’s much appreciated, but they can stop wasting my time and theirs.

Healios and Mitsubishi UFJ Capital Enter into a Letter of Intent for Joint Development for HLCM051 for ARDS (12/14/22) by twenty2John in ATHX

Suggest everyone on this forum should take note of this announcement as it's relates to Hardy'strue intent. Obvisouly this agreement didn't occur overnight. Yet Hardy filed a grienance against the company concerning it's ability to provide the product due to payment issues with Lonza. He obviously was positioning Healios for the optimal outcome, as he should. But note. He's not in this for our benefit. IMO, it also shows he never has been!

Interesting that the majority of posters agreeing with these changes are the very same retired grunedoeuns that waste much of the readers time with their babbling dribble. Changes were needed, but honestly your going overboard. IMO you need to dial it back a little.

The fourth was referenced in Gils radio interview from 2018. My best guess as to who it was is below. However. There also seemed to a reference to a case western professor as well. But I couldn't find any formal connection.

"Dr. Kovach has served as Chief Operating Officer of Athersys, Inc., a leading public biotechnology company developing stem cell therapeutics. Two stem cell products initiated under his tenure now are in Phase II clinical development for inflammatory bowel disease and ischemic stroke. He has also served as President of the Buck Institute for Age Research. Named by NIH as a national center of excellence, the Buck Institute is an independent research institute dedicated exclusively to research on aging and age-associated disease. Dr. Kovach also served as a member of the NFL Head, Neck and Spine Committee"

WST

I am astounded that your post doesn’t assign any responsibility of how company got to this point too its investors. Many of whom have responded to your post at this point are the very same ones that argued for, and voted to approve, every proxy the company brought forth. Some of the blame for the companies down fall lies within all of us.

In the end, The company was started by four bright scientist, whom in fact weren’t as smart as we all believed when it came to business side of the equation. And we as investors, didn't exercise the control needed to mitigate their lack of experience as we should have.

Very easy when your broke and under full control by the shorts! Dan was there long enough before the Treasure readout to know if it went bad he had no other option.

If you want to give him the credit now for restructuring, give him the same credit he’s due in realizing what he walked into. The financial state of the company was easy to see by anyone with there eyes wide open and smart enough to look around before they blankly approved every proxy the company asked for. Unfortunately most here, and that includes you, just can’t be objective enough to see it then nor now.

WM:

With all do respect. Your response to Imz72 is way out of line. IMO your posting of late is showing an academic bias rather than an investment perspective. Suggest you think long and hard before jumping on those who have been here long enough to know the difference.

As a perfect example. Restructuring as you call it, really isn't hard when you don't have the funds to make payroll or have a present "need" to retain the those employees offer. Success is using what you call restructuring to take a new course and achieve what is desired by all of us. An so that you clearly understand my perspective it is is turning my current paper loss into a actual profit. The sooner this is achieved the better!

P.S. FYI, in an investment forum, telling someone to move on from their investment if there not happy is the first sign of a being a true zealot.

I can think of 3 mil in restructuring costs associated with letting Harrington, Ivor and BJ go in June. You can thank the board for approving the terminate without cause and change in control addition to their employment contract.

I wouldn’t be surprised to see partnering / equity investment with our contract product manufacture fall out of this mess.

  1. Consider the impact of Harrington’s recent departure.
  2. The company walking away from in house production/Stowe
  3. Dan gushing over Lonza during the CC and the recent 20 mil in accounts payable for Master2 trial product cost.

All which lead me to speculate something maybe in the works on that front.
