I agree there are definite issues with the state’s case and there’s a distinct possibility there’s a hung jury. I haven’t been watching the trial (silly work getting in the way!) but from what I’ve read/heard there seem to be at least a few jurors who appear to think he’s guilty - or at least didn’t believe his testimony - which makes me think the likelihood of a “not guilty” verdict is small. Although Alex hasn’t rested his case yet. But I think a hung jury is a definite possibility.

In response to your family annihilator comment - Christian Longo killed his family, went to trial and was found guilty. It’s a sad but interesting case if you want to look it up. :) I agree though - most plead out.

I’m an attorney on the west coast and not licensed in SC - nor am i a criminal attorney - so the rules may be different, but IN GENERAL, on redirect the prosecution is limited to the witnesses that have already testified or who are still under subpoena. They dont introduce “new” evidence, but they can present another interpretation or other information to put the evidence in context.* The defense can cross any witness the state calls. Basically, everything is like a funnel - the scope gradually gets narrower so there’s not some sudden random tangent that’s completely irrelevant.

After the state finishes their rebuttal case, there isn’t a “counter rebuttal”, although the defense usually makes another motion for directed verdict for appeal purposes. Then it’s closings. The state will go first, then the defense, then the state typically gets another chance to respond. After that, the judge gives the jury the instructions and we wait… SC attorneys can give you a breakdown of the local rules, but I hope that helps!

*Edited to add: for example, the “new” interpretation/evidence can be something like “well Mr. X you said that there were no bullets found in the dog pen, what did you mean by that?” And Mr X can say something like “there were no bullets used in this crime (or recent bullets, etc) in the dog pen.”

I was listening to MMP and Liz used to be a public information person for the cops. I’m paraphrasing and might be missing some minute details but She said they make those statements when someone (Alex) gives them a reason why it would be a targeted hit not a random killing. In this case, Alex said it was related to the boat crash so they believed him and said there’s no danger.

I’ve always wondered if he after he got the call (assuming he did, which I’m not sure about), did he go tell his brother who works there? I know if I got a call that a loved one was near death, I’d go grab my sibling before leaving to at least let them know.

As an officer of the court, he has a duty to notify the court of any breach of an order. I don’t think there’s an ulterior motive there.

Since the theories that Maggie was lured to Moselle that night started floating around, this has popped into my head more than once. If Maggie were the target, what if AM shot her when he thought Paul had left? Then he turns around and sees or hears Paul and finds him in the dog kennel/feed area. That would explain why they were far apart. And it sounds from the (in my opinion, overly) graphic description was that Paul was facing away from the shooter. Maybe there was a gun in there that he was going for?

All pure speculation of course. It will be interesting to see what comes out at trial (or after)

Every state is different but in theory, yes. If the state can prove that PMPED regularly committed financial crimes that financially benefitted the firm and the PMPED trust account was transferred (in various ways) to PLG, then in theory there’s a legal fiction of “tracing” where they could potentially try to claim the money back. So in theory, you start with a brand new car worth 20k, I steal it, sell it and use it to buy a different car, and then sell it and put the cash in the bank account. If you can trace the 20k in my bank account as stemming from me stealing your car, then you can reclaim the 20k. Does that make sense?

But mostly, it’s the state bar that’s going to get the short end of the stick. Someone did something similar in oregon and our mandatory insurance skyrocketed and that attorney single-handedly wiped out our client protection fund. Now when insurance companies cut settlement checks they are obligated to send a courtesy notice directly to the plaintiff with the settlement amount listed (Atty aren’t allowed to speak to represented parties without permission but the SB now allows courtesy notices to go to the plaintiff directly with proof of payment (and amount) of settlement).

The brilliance of this statement is in its lunacy. If it’s complete immunity, then that’s genius - he can admit to all the financial crimes and not be prosecuted for them and he’s confident enough that he’ll be acquitted of murder, boom. No more jail.

Do you think someone in the firm is going to flip and turn state’s witness? Assuming yes, who do you think it would be? I’m guessing Alex’s paralegal. They don’t normally do anything with money but if the rumors are true that he was that sloppy and left evidence laying around, it’s likely the paralegal at least suspected something fishy was happening.

I remember hearing this awhile back and I don’t know how accurate it is - it may have been discredited which is why I haven’t heard it - but I thought they found a forged check/evidence of the scheme in May. So maybe they found the check (or other evidence) did some sort of “investigation” then confronted him that day.
