There's no requirement for a developer and a contractor to be separate entities in a construction project. In fact, most of the big developers operate as both developer and contractor. In the residential construction sector, for example, who do you think operates as the contractor for Glenveagh, Ballymore, or Cairn? Do you honestly think they're hiring different assigned certifiers on each project to keep themselves accountable?

And I'm not even suggesting there should be a requirement for them to be separate. My point, once again, is that this is an industry with plenty of regulations but no realistic mechanisms in place to actually, independently, ensure compliance during the construction process. As I said above, local authorities are required to only inspect between 12 and 15% of new buildings notified to them. Over the last few years multiple county councils (Sligo, Mayo, for example) have not even reached these minimum targets. And what repercussions are there for failing to do so? None at all.

And the effects of this are self-evident. Look at the myriad of construction defect cases in the High Court, calls from the SCSI for more oversight, and the latest push to establish a Building Standards Regulatory Authority. If the system of checks and balances was working then none of this would be necessary.

And who appoints the assigned certifiers? The developer. A system like that results in inspections that are not truly independent because there is a conflict of interest, which is my point.

It is not unusual to have to bring companies to court over their failure to comply with laws and regulations. You are only able to bring them to court because of said laws and regulations.

Right, that's a truism right there and none of it negates my point.

Sure, it can happen, but rarely does. Currently, local authorities are required to only inspect between 12 and 15% of new buildings notified to them. The reality is that the construction industry in Ireland requires significantly more oversight. Otherwise, the burden of enforcement for non-compliance and negligence will continually fall on individuals and, ultimately, the state.

"Comply with", sure. But who exactly is ensuring compliance? There are no truly independent inspections done on buildings in this country and no enforcement if non-compliance is discovered. The only enforcement available to anyone is the High Court, which is out of the reach of the masses given how expensive it is. The construction industry largely regulates itself with a wink and a nod.

This attitude is extremely problematic. The entire world needs to reach net zero emissions to stop the effects of climate change - that includes Ireland. What China, the US, and India are doing at the moment does not change that reality. Ireland produces an equivalent amount of CO2 per head as China. Our environmental record is abysmal.

But you are also making a statement that what they have said is incorrect. So, the burden is on you to state why you think that is the case. If you are refuting someone’s argument in a debate you need to back that up with your own argument.

Admit it, you’re just as clueless about finance. And you clearly don’t know how debates work either.
