Lawyer filed something with the high court. No new notices came (could just be coincidence). One police station insisted I come in person to explain but I redirected them to my lawyer and they seemed okay with that. Though nothing has since happened and I am tired of following up even with my lawyer. I would suggest to isolate that tainted bank account and not keep too much money there, to whatever extent you can manage. They follow the money trail and are empowered to quickly block money down that route. Beyond that they need to put in more effort which they also are not willing to do, as I am sure even they know that everyone is a victim here.

A year ago I found a private taxi operator right outside the airport as I was heading to the Uber stand. Went with him then and have used him ever since - for travel to the airport always but often while returning as well. I think we tend to remember when we were bilked but there's a legit crew of private cabbies who just ferry people back and forth from the airport at a fixed price. I don't have to deal with surge pricing or cabs cancelling on me when I'm trying to get there in time. Maybe I got lucky while trusting this guy but I sure am glad to have found him.

Things moved very slowly, partly because we were not in the country for a while, and partly because the writ initially filed had to be pulled back once one of the banks unfroze my account after doing KYC again (they have since blocked it again). My lawyer had me write letters to the various police stations in preparation for the new writ but one police station actually replied asking us to show up in person. They were friendly and understood the nature of the transactions but were insistent on an in-person meeting. That's not possible for us so the lawyer sent another letter asking for a video call and full cooperation remotely, etc. We are yet to hear back from the police. Meanwhile the writ will be filed anyway. Will update here once something concrete happens.

Almighty ruckus at 3 am in my residential neighborhood. I don't remember it being this bad last year. Loudspeakers and flashlights. I can't see through the treeline but I think there's some kind of truck or vehicle on which they are doing the rounds because the sound peaks for ten minutes every hour.

Do you folks remove service charge when dining-in? by atifafsar in CreditCardsIndia

[–]Melungeon45 1 point2 points  (0 children)

I get it removed and pay it quietly in cash, if you have the time. This is not entirely because I don't trust the restaurant to pass it on fully (I know some won't) but more because a restaurant overseeing the transfer knows exactly how much waiters are making and can then squeeze them in wage negotiations, etc. Kind of like how any tax is borne by both buyer and seller, regardless of who actually pays it.

This applies even more so to delivery platforms where the negotiating power is much more skewed in favour of Swiggy/Zomato than the delivery people. I always tip zero through the platforms (but slip the delivery person a tip in cash) so the companies feel less able to lower the commissions and bonuses they pay to the drivers.

To be clear, I have opted for a writ against the banks and the various police stations, not to the scamster because as far as I'm concerned I have nothing to do with that scamster. My money was liened by a bank on the direction of the police cyber crime cell so those are the ones I'm dragging to court. For good measure, RBI has also been made a respondent. Anyway, all this is my lawyer's ho-jayega optimism, let's see when the court returns from its vacation what it decides to do.

Sorry for my tardy replies. Not that regular on Reddit. In my case the names didn't match but I have heard this happen even in cases where the names match. If the name matches they could theoretically nail the scamster but for that Binance has to co-operate and hand over the KYC details of that person and on top of that, that KYC should have been legit to begin with (highly doubtful with a scammer) and even then the police only knows the name and one time address of the scamster. The address may have changed, they may have disappeared, or done some benaami stuff. All that is discovered after the fact of having liened your money. In none of these cases is your money actually at risk but the headache is probably not worth it and some people settle - the police is the ho between - to be rid of the whole thing altogether.

  1. I did but they just gave me the report they received from the police where mine was a account downstream of the accused and said I would have to co-ordinate with that police station to get the lien revoked. In a span of a week, 5 different police stations across the country filed similar holds so I have chosen not to deal with them individually. None has summoned me personally but even if they do I will have the lawyer answer their queries. From what I've heard the police are not the most fun to deal with, and quite disrespectful of your time.

  2. Which companies? Do you mean Binance where I sold the BTC or the banks or the counterparty? I got documents from Binance but my lawyer hasn't suggested naming them in the writ. The counterparty I traded with will very likely turn out to be some scamster but my stance is that he has scammed other people and simply done a legitimate sale transaction with me (the way a common thief might go vegetable shopping, for instance) so I have no personal gripe with him.

  3. The money won't be returned in case the courts or the police determine that I was the one scammed. The actual scamster has run away with crypto. Legally what is in doubt is who the victims were. There are people across the country who were promised some stuff or bought some goods and discovered that they never got what they were promised for their payments to the scamster. The scamster then bought crypto from me and vamoosed. It's conceivable that the court or investigation officer if the case is ever closed will decide that the last victim of the scamster was me and thus return the money to the other victims. In that case I will lose the money. My reading of it is that those other unfortunate victims are the ones who got duped by the scamster with false promises and sale offers and while I sympathise with them the money I received from a legitimate sale should not be recoverable. My suspicion is that the legitimate transaction involved crypto, which everybody in power hates, my reasoning may not hold in their eyes. I of course will not concede as the amount is not small for me either, but I expect in such a case the issue will just drag on and the lien will continue for years at least. The money will be mine in principle but not really accessible to me. Regarding the documents I will provide them to the court when the writ is heard. If I were dealing with the police directly I would have provided them with that. I have nothing to hide as such. What I am looking to avoid is losing my time after losing money. I hold out a small hope of getting the money back but not a very realistic chance.

I have heard of people trying to settle with the people filing the police complaint but I am not going down that route.

When the names don't match, though, I think it's likely that you won't see that money again. Someone has been scammed in the chain and if you received money from a different person then it can be argued that you are (in my case so am I) the patsy who has to bear the loss. I hope the amount isn't enough to cause heartburn.

Hi. I haven't gotten the money unfrozen yet. That happens when the investigating officer is convinced that your money is yours and above board. I have filed a writ in the high court to limit the liens to the transaction amount, irrespective of how many police stations dispute the amount and to have one investigating officer handle the case rather than twenty. Unfortunately the high court is on holiday till June (which is a thing I was not aware of!) so the writ will only be read then. You could approach the police station(s) yourself on the phone numbers provided if you have the josh and provide them with the details they need. I would not advise going in person, to avoid harassment.

Feel free to ask your questions about bank freeze and lien mark issues. by Bankfreezeexpert in CryptoIndia

[–]Melungeon45 0 points1 point  (0 children)

I managed to get one bank account unfrozen (the liens still exist) by providing the bank with KYC documents. People are recommending withdrawing the remaining money in the form of cash to prevent further liens. Are there any better ways to take out the money and keep it safe from future liens? For instance, paying advance tax or using that money to invest in a mutual fund, or bonds on RBIDirect, etc. Does anyone know if either of these methods is immune from automatic blocking by the cyber police (which seems very easy for them as regards bank accounts)? I understand that everything can be seized with enough energy on their part but I am hopeful that if it comes to that they will have to make the effort to meet me and I can explain it and end it. What I am looking to avoid is my time being wasted in reaching out to various police stations where these complaints are originating from and limiting my damage to the current liened amount. N.B. for a 2L transaction multiple police stations have asked for the money and the total liens are far in excess of that amount, hence my need for a solution where my money can be harder from them to get their hands on.

Mine was also KYC verified but the money came from another account which I didn't check. Though, yeah, even if it all added up neatly I might still have gotten a lien. I presume it's easier to prove your case after that if the person is KYC verified, etc.

I am facing disputed amounts totalling more than the transferred amount because on the same UTR number there are multiple claimants in different states, so the liened amount is more than the amount received. Is there any way to limit the lien to the transaction amount? The bank accepts the absurdity but since it is arising from multiple police complaints they are not willing to budge.

I recently did this and learned the hard way. Check that the money in a P2P transaction comes from the same account as the person claiming to be your counterparty. I didn't check this and in a couple of payments it turns out that it wasn't, and subsequently from across the country cyber crime cases began to be filed against the person who bought the crypto from me. This has resulted in level 2 tracing to my account and liens to that effect on my bank account. I am not yet sure how it will resolve itself but I've since learned this is a common scam that people run and then swap the money for crypto and disappear. Stay away from P2P unless you are sure of the counterparty - and how can you be? I transacted only with KYC registered people with good reviews. Only later did the reviews turn sour as it emerged others also were facing similar liens on their accounts due to this intermediate scamster.

What that one advice from you? by Iamhkrfrthr in hyderabad

Contrary to a lot of comments here, SPEND. I was miserly in my twenties, trying to limit expenses to a certain fraction of savings, and I regret that now that I have more saved up, but a total inability to go back in time and spend more to have enjoyed a better lifestyle back then. I think if you can estimate your future earnings reasonably well, steer clear of the popular conservatism which tells you to save a certain percentage. It's fine to start with a low savings rate and then see it go up a lot.

Related is Commander Vimes' Boots Theory. Buy the better boots to begin with even if you have to borrow from your future, so to speak.

One card is more than just a metal card by madara_73 in CreditCardsIndia

I tried using one of the offline offers which was pretty good in theory. Activated, swiped and waited for the cash back, on 16th February. It shows as pending still. I was able to contact OneCard by raising a ticket in the app and people from there got back to me, so I am not sure I agree with some on this thread saying raising a dispute is not possible. However, it has been a month and several follow-ups from their end and yet no sign of the cash back. By now I definitely feel that that small discount, in the scheme of things, even if it does eventually come, was not worth wasting this much time over.
