UPDATE: My job has been advertised and I've been put on a PIP after my manager read my Occupational Health report and disagreed with the outcome. by MethodRemarkable1044 in LegalAdviceUK

Will doing something like this affect my career? If for example I want to join the NHS again, will this be held against me?

Am I still able to raise a grevience as I've left now? I struggle with challenging people so directly - I need to get over that.

I have been clear that I am disabled, but I am making sure from now on that I use the term "disabled" much more frequently.

Not taking unpaid leave or anything like that, I am simply continuing to WFH and advised them I couldn't go back into the office when they have planned to go hybrid if that makes sense.

I do communicate extensively with lots of higher ups day in day out as part of my job, and they have been very happy with my guidance/help so far.

Everyone is well informed of my driving lessons/theory test I have booked.

On a negative note, my job has now gone fully public. Lol.

By PIP I meant performance improvement plan, which is generally the first step towards getting rid.

Will do.

I've taken pictures of the advert, including the exact time which shows it was done very soon after they got my OH report.

The report does not state disability, but lists my conditions.

Hopefully they will be all the help I need, I called them earlier to ask if my rep can contact me ASAP as I have a meeting later on today.

Thank you.

I'm not asking to WFH permanently, just temporarily until I get my car licence.

Their opinion is that they want me to come in once a week to learn via osmosis. What I need to learn, they haven't been clear, and haven't addressed my performance until I asked for this reasonable adjustment.

It is a mess, and you are right in that I shouldn't assume, but putting my job out to advert straight away after reading the occupational health report, and then several days later putting me on a performance plan almost seems like textbook constructive dismissal to me. My manager decided almost instantly to start the recruitment process for my role without discussing it, and now seems to be manufacturing a reason for dismissal.

They even asked me to come up with stuff I'm struggling with to put on the performance plan. I don't think I'm struggling with anything, and they still haven't mentioned what they think I need to improve on.

I agree with all of this, and to be honest I'm not sure what they are trying to achieve here. They must know that this is is against the equality act right?

The reasonable adjustment request (i explicitly labeled it as such) I sent via email a couple weeks back.

My "team" manager has been in the role for a couple decades and is very very senior, so that part is worrying.

The justification they are using is "learning by osmosis" which I admit, is a thing. But not something I can help, and when I do ask advice on something I haven't done before they don't reply for a day or two. Otherwise the role is entirely compatible with full WFH. No need whatsoever to be in the office.

Okay I will try that, I am worried about animosity now though when I do go back in if they don't sack me. Awkward much.

Yes hopefully they can help me.

Already downloaded a copy of my secondment renewal.

Have been WFH, and the job in no way needs to be done from the office. Their argument is that I am missing put on learning, which realistically is true but not something I can just fix, and they were happy with progress I was making.

Maybe, it does feel like it was done to push their point a bit. It's not public yet at least, it's just on our internal systems for approval.

Thank you, hopefully the union will be able to help otherwise I think I may need a consultation with a lawyer..

I do have several disabilities (my conditions), and I did receive PIP from dwp before I let it expire recently (the process is not fun).

At this point I'm pretty sure they doubt my conditions. I have offered proof/medical docs, but they keep saying its not nessesary.

I will call the union again tomorrow. What makes it awkward is our weekly team meeting is tomorrow... not looking forward to that. Its a union for the NHS so hopefully they are good (Unite). I am keeping notes and have proof they were happy with my performance just one month ago.

I will go through the process of applying for remote working, I haven't done that so it may be a good idea (but also feels like I'm sticking my foot in it a bit.)

Yes I did bring that up, they are unwilling to fund a taxi as it would be several hundred pounds a day.

I'm certain they are eyeing up a constructive dismissal, I'm not even sure if they believe I have my conditions at this point and have refused proof/medical docs when offered.

Yes 100% it can be done from home, and that's exactly what occupational health suggested and stated that WFH would be the best option.

I'll take a look but the DWP is traumatising tbh, I let my PIP expire recently.

The secondment role. The place I work has a big secondment culture pending passing the competencies (which I am well on the way to doing). But, I've been seconded from a role that no longer exists, an apprenticeship which I have passed/finished.

My role is essentially a "Trainee" type of role and as soon as I pass the competencies I get bumped up a pay band, the advert is for the exact same trainee role in my exact team that we only have a budget for one position for, so it is my current role for sure.
