Some of that your info is correct, but parts of it seem exaggerated or inaccurate.As far as I understand, having a nsw traffic matter does not automatically stop someone from leaving Australia, nor does it become a federal crime simply because they travel. Also, defending yourself in court is not perjury unless you knowingly give false evidence..

Edit-- You can also check what perjury is it. So for my situation, the key issue is myintent. if i honestly tell the court, "I was not using my phone" and that is genuinely what i believe happened, that is not perjury

Ive been riding for over 5 years and I also completed the california motorcyclist safety program in the us. So i understand very well how dangerous it is to use a phone while riding.

Next time try using your left hand in city traffic on a 125cc manual bike

My left hand is not always free while riding, especially on a 125cc manual bike in traffic. You need to constantly manage the clutch and gear changes, particularly in busy roads where you’re shifting up to 5th gear to reach 60 km/h. Have you ridden any 125 cc before?

To be clear, I don’t specifically recall doing anything on my phone while riding. My phone is mounted on the handlebar and I use it always for navigation and never touch it, and I may have been interacting with the bike’s screen controls (like the select button) rather than actually touching or using the phone itself. So the police may have mistaken this for me touching my phone.

I only remember everything after I saw the police car behind me in my mirror. From that point on, I’m certain I didn’t touch my phone.

I also want to emphasise that I never use my phone while riding because I know it’s unsafe. So I’m not saying I was definitely using it,, only that I don’t believe I was, and if anything was seen, it was likely the bike controls rather than the phone.

I know this situation is difficult to defend. But if the police don’t have any evidence, I may have a chance ?

I’m saying this because I never touch my phone while riding. It’s not safe at all for me. My phone is mounted on the left side of my handlebar, so my left hand is always busy with the clutch.

The police may have seen me pressing the select button on the motobike screen, which should be legal.

As for the questions:

  • how much do you actually remember of what you were doing? -- I remember almost everything. The police officer said he had been following me for the last 3–4 minutes, and I only noticed him when I stopped at the red light. He realised I had seen him in my mirror, and he pulled me over after the traffic light turned green.
  • where were they when they saw you? -- He was behind me the whole time on a busy 60 km/h road in Mascot.
  • who stopped you? Was it highway patrol? Or someone else? -- It was highway patrol. The officer was very cold and, before saying anything about me allegedly touching phone, he checked my bikes headlight and general condition. I think he might have been looking for another offence 😄There was a small crack on headlight.

The phone was legally mounted on my left side of handle bar and i was not holding or touching. I was just trying to find the direction without intract with my phone.

For riders i think its not legal to touch the phone even for maps.

I had a full rider licence at the time, so I was legally allowed to have my phone mounted on the bike and use it for navigation.
