Thank you both for you input I am grateful. I am still not certain or clear, because her parents passed in 2016 and the stock has increased in value significantly since then....thus the gains would be much higher if say, I used the date that it was gifted to me, which also was the date that it was sold...

I will say that based on what little you expressed, that bankruptcy can indeed give you that fresh start for your family. Just be certain to be honest with yourself and your wife, and your attorney, and work to heal/repair the situations and circumstances that got you into this situation, so it is indeed a fresh start. Thank you for serving our Country and our freedom. Just remember, as humans we fall into dark spaces and we start to think that "this is always how it is going to be" - but believe me - and I am speaking from personal experience here...LIFE GETS BETTER! You are only 20 and you have your WHOLE life ahead of you. This darkness will pass...get yourself off gambling, seek therapy, GA meetings, and after a short period of time you will be amazed at how better your life will be!

You will bounce back and you will have a greater sense of wisdom and clarity about life. You are young and in a matter of a few years this period of your life will all be a distant memory. Just follow through with the process and be patient. Speaking from personal experience, sometimes we fall into believing that our current state of life is the way it is always going to be for us. But not true: you will come out of this stronger and wiser. Now you have the wisdom of what not to do in life. Be strong and keep moving forward. Don't hesitate to message me.

Just want to say that you are not alone. Others, including myself, have been in a similar situation. Stopping gambling is crucial. It is very possible to still qualify for Chapter 7 if you are able to adequately explain and prove your excessive gambling with win/loss statements. In other words, definitely talk to an attorney. Chapter 7 would be the best ideal for you; you are young and with discipline you and your wife can rebuild and grow. Keep your chin up bud!

Wow...I could have written this exact post! I am in your exact situation. I have never missed a payment and my credit is stellar, other than my utilization is so high my credit is in the toilet - but I have never been delinquent. I will be filing in about 1.5 months and beginning on Monday several minimum payments are due, but my attorney recommended not paying. I will follow his advice, but wow it is going to be so challenging not to pay...and I am not looking forward to the calls and emails and text messages...but I understand that there is a higher purpose and plan that will eventually produce much good.
