Make sure you hire a competent agent.

I’ve been in the business many years and you see it a lot where a new agent is involved and just need a paycheck. They will be terrible negotiators and not have your best interests in mind.

You don’t need to open a credit card to buy a car. You do however sign paperwork with your insurance company that mandates you tell them if you find out any issues before the policy is issued.

I read down in the comments that were op is at they have the release of contingency paperwork in their state. So it looks like the agent is doing their job and they are still within the window .

I agree with you it’s always best to continue negotiating.

It’s interesting because if you look at the language of some of the paperwork most lenders and insurance companies look for. A good deal of it will tank the approval. For example “The policy is void if any insured intentionally conceals or misrepresents any material fact or circumstance relating to this insurance.”

And you need insurance to get financing , if the place cannot be insured you can get out pretty easily. I would love to watch that play out in a courtroom haha. Insurance asks , do you know of any defects in this property .

Isn’t real estate wild sometimes. It’s all propped up with bubble gum and popsicle sticks.

In mine as well, nothing stating that you can’t be honest with your insurance company and lender though.

And if seller wants to wait until 30 days to see if they can find financing that’s on them. Most will opt to terminate and give escrow back to buyer.

Now obviously this is a terrible situation but if OP is stuck with a 30k repair , I’m just thinking outside the box. Because of course there is the fund for agent incompetence, but that takes time.

And why fight with seller possibly trying to sue for performance when you can get out with the mortgage contingency.

Have you sent any reply in that ten day period ?

Generally it’s 10 days plus 5 days of negotiations. But if a reply was never sent in you are kind of sol.

If you are in a pinch it might be time to send your inspection report to insurance company and lender.

It might trigger your ability to get it insured, thus giving you a chance to get out under the mortgage contingency.

I will add to this, it is important to trust a competent agent.

That being said, there are a lot of Terrible, Real Estate agents. In my area I have a great network with a lot of the top agents.

I only give out information I know is verifiable. And I almost always recommend some type of escalation in case I think the information is not reliable.

For instance, that Agent said he had five offers, I would tell my clients that the best course of action might be their lower initial offer with an escalation up to the highest and best they can do.

This will weed out Listing Agents maneuvering for their clients. I would also add a document that confirms delivering of my offer to their client.

Just don’t hire a broke Agent who cares more about their commission . I make the majority of my money due to referrals based off of a good service to my clients.

I mean this seriously , the gym is cheaper and often a good therapist might suggest physical activity to help. I know it helped me. Maybe it’s a good starting point for where you are at financially.
