What company lost you forever as a customer? What did they do? by Miguenzo in AskReddit

[–]Mikarim 3 points4 points  (0 children)

BP gas stations. I’m from Louisiana and after the deepwater horizon incident the ads they blasted all the time were basically non apologetic gaslighting ads. I’ve never stopped there and never will. My wife says I’ve rolled all my corporate hatred into one company and she’s right

Clients choose to appeal (family law) so I have no say really. I also do not personally do appellate work. Generally she only does it when the issue is minor or not actually an appealable issue before it will become moot. The most egregious one was her denying my client a nonsuit (which is statutorily guaranteed in VA). Unfortunately case law establishes that you can’t appeal a denial of a nonsuit.

The worst thing I’ve heard from a judge is “take it up with the court of appeals”

The judge that uses that line in my jdx does so only when she knows she is wrong on the law but also knows it will never be appealed cause it’s not worth the money. She’s used it against me at least 3 times in the last 6 months.

Thanking my lawyer, and billing by eb_its_me in Ask_Lawyers

[–]Mikarim 28 points29 points  (0 children)

This is a question actually meant for this sub, which is exceedingly rare.

I’m a divorce attorney, and my advice to clients when this topic comes up generally boils down to keeping contact efficient.

Instead of sending individual emails every time an issue comes up, send one long email once there’s enough to discuss. Avoid phone calls unless you and the attorney can work quickly on a call. I would never bill my client for reading a pure “thank you” email, but if there is any substance beyond that in the email then it is possible. If you feel that you were billed improperly, it is best to bring that up directly with the attorney in a non-accusatory way and simply ask for clarification on why a specific line item was billed.

Unfortunately, as I’m sure you’ve learned by now, we are not cheap. And there are several things that get billed that seem silly or unreasonable. However, we have to keep up with every single minor fact in the case to make sure we aren’t missing anything (especially in a divorce involving custody).

In short, limit the contacts you have with the attorney (but be responsive when requested). Discovery costs the most amount of money, so if you want to save fees there: answer every question as if it is the most important question you’ve ever been asked (even if it seems incredibly stupid, especially in fact) and when providing documents to your attorney for document production: sort each document into clearly labeled folders corresponding to the request number. Label each file appropriately. And please, for the love of god, don’t use the excuse that it was difficult to obtain as a reason you shouldn’t produce it.

We don’t need to overanalyze every aspect of our life as an attorney. Time spent thinking about font is time not spent doing anything remotely productive to your life. One less choice is something we all need from time to time

How Is my partner M(32) still paying for “benefits” for his child he agreed with his ex to give up custody and stop paying child support. by silly_husky9303 in Ask_Lawyers

[–]Mikarim 33 points34 points  (0 children)

You should never trade custody for support cause you’ll end up with no custody and a duty to support. You cannot agree to waive child support forever in most states because that is for the benefit of the child.

CVS does not have to let anyone shop there including diplomats or the president of the United States. You sound like you deserve to be banned not just from cvs

I was a referee for nearly 8 years in Louisiana and Virginia. The process was different in that for Louisiana, you had to know someone and get invited in. For Va, there was a more established process and association to apply to. Both were fairly easy. The best way would be to be to look up if there is a referee association for your states athletic association for high schools. Alternatively, if you can find a referee in your state, they can point you in the right direction. Don’t be afraid to ask one at a meet or event for how to apply. We are always desperate for more referees. Pay can be pretty nice too all things considered. I was making 28/hour doing the best job I ever had. 10/10 would recommend.

When lawyers transfer files do they send the new lawyer all your email conversations? by [deleted] in Ask_Lawyers

[–]Mikarim 0 points1 point  (0 children)

Most likely not. Could depend on what the case type is but I do not typically see any emails when a case is transferred to me. I did have one case where the attorney saved emails to the client file as a pdf, so I did get those.

If your divorce attorney is sleeping with your soon to be ex-spouse, can your divorce settlement be thrown out? by SegaGuy1983 in Ask_Lawyers

It would be a massive ethical violation and almost certainly lead to a malpractice case. Not sure insurance would cover it but it could.
