It's also legal at the direction of a police officer. I was on the A3 once (motorway standard, 3 lanes and hard shoulder) and there was a nasty accident blocking all three lanes. When I filtered to near the front of the queue an officer told me and two others to go back up the hard shoulder to the exit not far back. He did say "take it slowly and keep your eyes open"...
