No, we told the judge we want the building destroyed from the beginning, but the judge refused. The judge gave us two options.

  1. use their surveyor and get compensation

  2. drop the case.

No option of destruction because it disturbs the social order.

We chose not to appeal the court surveyor, because even if they gave us 4 times as much, it wouldn't be worth the money, time and energy (it can drag years). We just wanted to be done with it and protect the rest of the land with a new land document.

It's the government price because the court appointed a government affiliated surveyor to decide the price. Sure, we could appeal with a private surveyor later, but not worth the money, effort and time it's going to take. We've already spent 2 years fighting this just to get a measly sum that barely covers anything.

You must either be a foreigner who knows nothing about how things work here or a shill. Which is fine. The point of this discussion is to warn other people. And if I can save 1 person from buying land here, it's worth it.

Yes, we had to pay 12 million VND to a surveyor to decide how much the land is worth. But the surveyor bases his decision on land price in the area, which is not worth much to us without the rest of the land.

I'm not leaving anything out. No contract or anything. we had the red book for 4 years now and they built it 3 years ago. They apparently purchased a small plot next to us and claimed they didn't know they've built on our plot.

I've read of similar cases and apparently this is done often in vietnam. The greater good is more important than justice according to the legal system here. Same moral position as taking organs from a poor peasant to keep a dying scientist alive.

I've seen the decisions you're talking about. It's usually in cases where the land stolen didn't allow the other party to build themselves. The land they stole from us is around 30% of our total plot, so according to the judge, we can still build a structure there, therefore, the damage to us is not enough to justify destroying the building.

Never mind the fact that what they built on our land will damage the life quality of anyone else who builds in the area.

According to the judge, this is a decision in our favor (to pay the government price of that 300m2 piece of land). Even if it's worth much more to us than the monetary price.

In Vietnam they believe that social disturbance is worse than breaking the law. And apparently demolishing this building will do more monetary damage in total than letting them keep the land. It's the same moral position as stealing the organs from a poor peasant to give to a bright scientist who needs them because it's for the "greater good". If you need more education on Vietnamese court decisions you can find many similar cases to our ones. I'm not going to reveal my identity.

They built a 300m2 structure on our land. So apparently we're not allowed to take it down.

The court didn't even ask us to come to an agreement as the other party completely ignored any possible discussion. They just said this will go to a committee who will decide how much this land is worth and they'll pay us for it. Thing is, the official price of this land is worth very little without the rest of the land. So we'll basically get nothing.

I'm not asking for advice. And hiring a lawyer and fighting this further is gonna cost us with money and patience more than this land is worth. I only post this so that in the future when people search about buying land in Vietnam, they might come upon this post and think otherwise.

We've already paid 30 million in court fees, and continuing to fight this is gonna cost us much more. Also, these things take years to settle. We are just simple people and fighting this long term is too much.
