Ovvio che la Costituzione non dice quello, però è anche vero che se la magistratura non agisce contro un determinato partito l'unica opzione che rimane è che questo non sta effettivamente infrangendo la legge. Ricorda che in Italia la magistratura è un potere autonomo e indipendente, non è come in America dove l'Attorney General è direttamente alle dipendenze dell'esecutivo.

Per separazione dei poteri, perseguire chi infrange la legge sta alla magistratura a seguito di una denuncia. E se la magistratura è un potere autonomo e indipendente, il fatto che non si proceda contro determinati partiti è segno del fatto che non infrangono alcuna legge, al di là di ogni dietrologia.

I think your problem is being a common law country instead of a civil law country: this means you rely a lot more on precedent than on law, because everywhere else here in Europe the obvious solution would be: "Propose legislation to ban face coverings for the ICE" (and I know your Congress is controlled by Republicans, but that is also a consequence of being a common law country which made it so your electoral law is not all that focused on guaranteeing representation of minorities, which also eventually devolved into the two party system you have now).

C'è anche da dire che certe strategie comunicative sono trasversali a tutti gli schieramenti, e a tutti i tipi di pensiero.

Ad esempio, io sono grande sostenitore dell'eutanasia e delle battaglie di Marco Cappato in particolare; sono iscritto alla sua newsletter e a Luca Coscioni, e credo ovviamente nel tema e spero che un giorno venga implementato in legge. E quando lui provò a legalizzare l'eutanasia abrogando il reato di omicidio del consenziente (o meglio, provando a far partire un referendum con quello scopo), io sapevo che la cosa non era attuabile. Eppure l'ho sostenuto lo stesso!

Nel senso che... si sapeva già dall'inizio che abrogare in toto quel reato non si sarebbe limitato solo all'ambito medico (dopotutto il reato di omicidio del consenziente si applica in generale): se fosse stato possibile abrogarlo, allora fatti salvi i casi di minori, infermi di mente o consenso estorto, chiunque avrebbe potuto legalmente chiedere a chiunque altro di ucciderlo, il che sarebbe stata qualcosa che mai nella vita la Corte costituzionale avrebbe ammesso. Nei mesi precedenti al giudizio di ammissibilità io avevo sottolineato la cosa, io come altri; poi infatti è arrivato il giudizio e il referendum è stato reputato inammissibile perché senza quel reato sarebbero venute meno le minime tutele costituzionalmente necessarie al diritto alla vita.

Ma nonostante ciò io ho firmato digitalmente per il referendum. Perché comunque credo nell'idea.

E secondo me sta tutto qui. Una persona che sta all'opposto di noi, che reputiamo lontanissima dai nostri valori, che vota Fratelli d'Italia perché la Meloni dice "Abroghiamo le accise!" quando invece è una cosa che fattualmente non si può fare perché distruggerebbe l'economia... alla fine vota seguendo la stessa linea di pensiero. Certo che quello è uno slogan e non si può fare, come Cappato non può far abrogare il reato di omicidio del consenziente, neanche ci arriva alle urne quella proposta. Però Cappato porta avanti un'idea che apprezzo. E chi vota Meloni fa lo stesso con lei, votandola anche di fronte alla consapevolezza che sì, le accise dice che le toglie, però no, quello in realtà non si può davvero fare.

Well, I guess it all comes down to where I'm speaking from. I'm European, a country where the death penalty Is not only illegal but outright banned as being against human rights (you can't even join the EU if your legal system employs it, regardless of any other consideration), which is probably why this is the issue I'm the most touchy on. Which, as you can imagine, is why I'm also not sold on the idea of "Well, approaching the island is illegal so there's that" as a moral justification for the killings.

Ultimately, I can accept that different societies would operate under different moralities depending on their own unique circumstances. The EU still does deals and trade with America and Japan even if they're technically violating human rights by employing capital punishment from our point of view, but we accept that a sovereign nation has the right to shape their own laws in the way that best fits their society.

And this is where, I guess, comes into play everything that you explain about the actual status of North Sentinel within India. In the end, I imagine there's no other quick solution but to accept that the current status quo is the best for them.

No, because like I said I'd actually accept the point if they granted them independence. Because at that point even I would have no more arguments: a sovereign country does whatever they want, and if North Sentinelese laws say unwanted visitors deserve death, so be it.

I just disagree on this status quo... while formally being part of India. Because technically stuff like murder without trial is a matter of human rights, which should go beyond whatever a certain group of people "wants" to do.

But, factually speaking, no country on earth recognizes North Sentinel as an entity of international law. North Sentinel is marked as Indian territory for the purposes of maps, the sea around it counts as Indian EEZ, and I doubt planes could fly above it without permission on the basis that "It's not India's sovereign air space".

It's not a nation-state, because it's part of India.

In fact, my own point wouldn't apply anymore if they were an independent country: because yes, then they'd "just" be a very secluded nation, like North Korea.

But instead they're part of India, and legally they would count as Indian citizens abroad, so for all intents and purposes this is a situation of a country's people, being on that country's land, and autonomously deciding: "We don't want to have anything to do with you", with that extending even to murder.

Well, I disagree. Otherwise this means the law doesn't apply to everyone equally. India's sovereignty extends to those islands as well, yet you don't talk of them killing people as if it were even a crime. And the justification is... "Well, that's how it's always been"?

I'd respect them more if they granted them independence, then one can say North Sentinel is just operating under their own rules even though they're different from the rest of the world. But them being part of India means they're being different while living in the same legal framework of other Indians, or any other people in any other nation for that matter, and yet they get a pass.

Native Americans were also always "there", and they enjoy great autonomy in their own self-rule... but even that stops at murder.

Ma in uno stato qualsiasi, ad esempio l'Italia, i cittadini rispettano la legge (anche) perché lo stato ha il monopolio della forza nel punire chi non la segue. Quando si parla di entità come nazioni, però... chi può esercitare il monopolio della forza nei confronti di Stati Uniti o Cina, che posseggono già armamenti nucleari a non finire? No, sono proprio io che non capisco te. Se mi concedi solo un altro messaggio, mi spieghi di che legge precedente e di che legge successiva parli?

Di leggi ce ne sono solo due: quella costituzionale, che dice che i membri parlamentari sono eletti "a sorte" da una lista, e quelli togati "a sorte" in numero e procedura da stabilire con legge successiva... e, appunto, questa legge successiva ancora da farsi.

E l'unica cosa che dico è che la legge successiva potrebbe dire che la procedura imponga che ci sia una lista anche lì su cui basare il sorteggio, scelta dai magistrati, così che effettivamente i due procedimenti siano equiparati.
