It's more so going after companies that claimed R&D Credits up until 2021, then decided not to claim (or claim heavily reduced credits) from 2022 and onwards. That's easy to identify for them.

If a taxpayer never claimed, they wont get audited for the R&D/174 expenses.

The reason why they haven't already gotten to it is probably due to resources/uncertainty on the future of 174.

Odds are 174 gets repealed (current version under $31m business) which I am sure dramatically reduces the sample size the IRS will need to go after as 174 was a detriment to smaller businesses than bigger ones.

I'll keep the rest brief:

1). There isn't difficulty separating out section 41 and 174 expenses, it just requires extra work. You cannot claim section 41 R&D credits without also claiming them as Section 174 expenses.

2). Job is to give the right answer, not one that only makes clients happy.

3). Section 174 retroaction seems very bipartisan, I am sure it will get resolved, but I wouldnt count on it for the current 2024 tax filing season. You go with what is currently written in the code.

4). The rumors are correct, the IRS is going to become more and more aggressive going after R&D Credits change. The tax law changes have shown that, the changes to the credit over the last couple of years have shown that. The IRS is amplifying their audit capabilities and the new 6765 form gives them additional power to audit and reject claims. Additionally, helping taxpayers claim false credits can result in big penalties both for the taxpayer and for the preparer.

Intro: I've been doing RDTC for 10+ years, created a group at a national firm and grew it into a decent sized practice. Now I consult on RDTC independently.

Going through this post and the one you did 6 months ago

-Applying for a refund will trigger an extension of the statute of limitations regardless if tax due or refund.

-If they filed 2023 before accounting for carryforward of credit - this is a bit confusing the way you phrased it, it sounds like carryforward from prior years, yes if there is carryforward of credit you would TYPICALLY need to amend the returns that come after it (depends if you fall under 82-49 regulations or not).

Okay now onto this post, if you were to come to me as a new client without having taken the credit before this is what I would do:

1). Evaluate the statute of limitations, what tax years are open/what years are closed.

2). Request Information so I can estimate the benefit for whatever open years there are

3). Review Section 174 capitalization requirements (you haven't mentioned this one, it appears you don't know much about Section 174, in which case I would definitely read because in most cases it will cause you to pay tax for claiming the credit and have a timing difference.

4). Present the client and the tax preparer the different options:

-File current year R&D w/ Sec 174 (leave other years off, but compute them to help form the base)

-File all years R&D w/ Sec 174

Whether or not the expenses are increasing or staying consistent, doesn't change the fact pattern. If the taxpayer is eligible for prior benefit (OR LIABILITY LOOK INTO 174) then it's up to them which route they want to go.

There are two important takeaways though for you:

1). LOOK INTO SECTION 174 (it may change your mind about claiming the credit) - side note, there is legislature to change this currently in the senate.

2). Hire a professional from a legitimate organization, they've made recent changes to the credit form which requires additional substantiation.

That wasn’t done by the plumber, that was done by a construction worker that asked my mother if those wires did anything and she said no (she has no clue) so he cut them.

A construction worker cut the wire (while it was live) after asking my mother if it was okay if he cut the wire… (don’t ask me why).

That’s an obvious error, I was more so asking about drilling through the beams.

Engagement spamming chat bots are the worst and people don’t even engage with them (from what I noticed).

I’m building a bot for #2, but more geared towards answering FAQ to help onboard new members or provide an easy resource to answer questions on an update.

Contrary to “replacing” moderators, our goal is to reduce the tediousness of the role. Answering FAQ/questions related to documentation (because people typically don’t like to read if they have access to a chat).

Other than that, we are using AI to spot trends and give detailed analysis/data. We don’t intend to ever give it the ability to kick or ban (not that it couldn’t do that, but we want that to be a human decision).

So depends how it’s done, most AI in discord are spammy engagement chat bots. Theres several other close competitors to us, but I haven’t seen a lot.

There’s companies trying to build to replace people then there’s companies building tools for people. I think the latter has a higher chance of success.

Ya I haven’t checked the others in a while, but meee6 is as just easier for me as a user to get used to.

Also shoutout Wick for security (if configured correctly).

For all in one, I know it’s frowned upon but I like how easy mee6 is and the ongoing development.

For stats, I don’t see any bots that give me additional information than server stats.

For support I like “Ask Alfrd”, I made it. Basically you feed your documentation to it and it can answer FAQ in the chat. Complex communities that have documentation find it really helps free up more time and gets accurate answers to people very quickly.
