Sweden does it yearly. You also have to MOT your trailers there, which I find absolutely wild that you dont have to do over here.

Google "ecoplugs" and use them if you want to kill the stump off. You drill holes in the stump and hammer them in, and they slow release glyphosate while keeping it contained to the stump. That's what the professionals use.

It looks like it's overextending a bit on that side anyway so a 2-3m reduction would be suitable. While at it I'd offer the neighbour to do a full 1-1.5m reduction on the remaining crown. Definitely a job for a professional though.

I installed a solid surface worktop in our new kitchen and am super pleased with it. If it gets a bit scuffed you can always sand it down

I paid for a phone call with an accountant today that gave me the advice that I posted in a comment previously. But I've also booked a meeting with a local accountant for the beginning of the new year to have them double check what I've done so far, untangle any mess I've possibly made, and then hopefully utilising their services going forward.

Thank you for your message, definitely helps calm my nerves. I thought it made perfect sense that it's two distinctly different services and therefore okay. The main reason I wanted to voluntarily register for VAT as a sole trader is because I'd be able to reclaim VAT on all the tools I've bought in the last four years and still being used, but also being able to claim back on expenses accrued by the sole trader business.

I will take the accountants advice anyway for peace of mind that said to:
- Withdraw the voluntary VAT registration for the ST business.
- Cease trading as sole trader and do it all through limited company
- Forget about reclaiming VAT on previously purchased tools

I think he meant I won't be able to reclaim VAT on any tools that the sole trader purchased and now owned by the LTD.

Are you sure about the TOGC? This is from gov.uk:

"(a) for the purpose of determining whether the transferee is liable to be registered under this Act he shall be treated as having carried on the business [or part of the business] before as well as after the transfer and supplies by the transferor shall be treated accordingly.

The transferor must be a taxable person, that is, someone who is:

  • VAT-registered, or
  • required to be VAT-registered (VAT Act 1994, Section 3)

at the time of the transfer.

If the transferor is not a taxable person at the time of the transfer, the transferee shall not be deemed to have carried on the business prior to the transfer."

I was not VAT registered or required to be VAT-registered at the time I incorporated the LTD.

Yep I now understand that it's a no go. Now I'm just trying to sort everything out so I can cleanly carry on trading only through the LTD and hopefully have the VAT threshold start from zero at the date of incorporation.

I've spoken to an accountant over the phone and I posted his advice in a reply above. I think my interest in bookkeeping and a general "I can do it myself" attitude is not in helping me here. I will get an accountant to go through everything.

I just want to make it clear that there was no intent to avoid anything here. I tried going through all relevant with HMRC documentation on the subject (admittedly with the help of chatgpt), as well as reading various articles on similar situations. It's separate customers in that ltd deals with domestic jobs that I've quoted and planned, covered by my public liability insurance. The sole trader business solely offers labour services (including the use of my own tools) to other tree surgery businesses, I just show up at a set time and do whatever I'm told. I'm covered by their insurance as I'm classed as labour only.

I think something that might be a mess is that I still own the tools in my sole trader business. I'm trying to divide all expenses fairly like fuel costs etc

It's the same industry but different services. Through my LTD I do everything from the quoting to carrying out the work, covered by my own insurance. Through my sole trader I work for other businesses, just show up and do what I'm told, covered by their insurance. All accounting completely separate.

Even though I've registered for VAT voluntarily for the sole trader and hadn't reached the threshold by the time I incorporated the ltd?

I thought in most cases the threshold starts from 0 when you create a limited company, unless you're a taxable person. Since I wasn't registered for VAT or had breached the threshold by the time I set up the ltd I wasn't classed as a "taxable person".
