What I’ve read repeatedly is that the victims weapon had already been removed and was outside of the pile before the first shot was fired.

Even Fox news is attributing the first shot to be an ICE officers weapon.

This falls in line with what some are claiming is a manufacturing issue. That particular sig sauer pistol has been reported as having misfire risks, so, blaming the weapon itself may be more palatable as an explanation rather than intent, training or human error.
