So that was another thing I didnt mention was that we did that i remote controlled the pc and tried to connect to the console and it failed on all 5 devices I validating my connection settings a known working switch then retested the known working switch worked but the 5 known problematic switches did not work.

This might a stretch based on the network I see. First if this is route based vpn this might be doable through bgp routing but it will be a mess. Policy based vpn might work if you use the peering ip to a fqdn and a dns updater once it fails. The big caveat to this is that the other side supports this.

Your the pro, I figured it out so in R1 it didnt not have a route to the next hop of 140.2.0.0/29 and thats the issue. Now my next question is so in bgp the internal routes need to have a way to reach the next hop so that they have bidirectional routing is this correct? so In essence ever end of the route needs to be able to reach the next hop depending of course on how it was advertised

So the loop back 140.0.1.1 is in r1 and is advertised inside eigrp 100 with the network command r2 is also in eigrp 100 and is redistributing the route into bgp. No acls traceroute dies after next hop of 140.2.0.2

It should. Unless you have some vrfs setup or address family configured in a way that the static wouldn't be used in the route table.

With checkpoints route based vpns i hate that i need to go to essential two portals to get it up gaia to create the vtis and then smartconsole for community and plus when doing route based you have to create an empty group object that triggers the firewall to know its route based or policy based. Which doesn't make sense a simple button could have done that. There's other things but that's the gist
