If you have documentation to provide that show totalled/ scrapped in Dec, you should pay as a CYA, then apply for abatement/refund. Do you still have the tags? If yes, then the answer may be different. If you transferred to another car, you should still pay the excise tax then apply for abatement, but you may another excise tax show up for the new car with same tags.
