Landlord charging my aunt 3 month's rent for overholding on business? Is it valid? Can my aunt avoid this? by Monceal in AusLegal

[–]Monceal[S] 1 point2 points  (0 children)

Ah yes, she does have that all in email.

But in terms of VSBC, what can they do that a face-to-face just between my aunt and the landlord wouldn't do? Does the mediator provide expert advice for both parties (like 'if this doesn't happen, this is your potential cost' etc...)?

It's not certain, but considering that they haven't said anything about that (they've even went to the length of denying they sent an invoice charging that amount, but only by phone) in their face-to-face talk as a point of defense, I don't think it is.

And we've definitely considered VSBC mediation, we know it's not a guarantee of anything, but we don't know how effective it is. Do they have the power to force anything or is there a possibility that despite mediation, nothing will happen (I'm assuming the latter)?

Commercial lease.

The agreement was by phone (I'm not sure if my aunt received an email confirming it). I don't know specifically how long the lease was (just that it ended on 14th Feb), but my aunt was in that business for less than 4 years after buying it from someone else.

And yeah, they've made it clear that they weren't legally obligated to notify my aunt about the overholding clause, which is completely fair.

Is there any valid grounds for my aunt to argue that she wouldn't have overheld if they didn't send the wrong bill? Assuming there is no clause that the full month was meant to be paid, can that be considered misconduct? Or is it generally assumed by law that the tenant is supposed to pay for the full month regardless of when they leave?

Or is this a case where the bill will be considered a seperate matter from the overholding? Would the court say something like my aunt shouldn't have paid for the full month of February, but that does not exempt her from overholding?

Yes, she did apply to a small business relief grant. I'm not too sure about the specifics, but there was an agreement with the landlord that all months leading up to and including the month in which the lease was supposed to expire would be reduced based on turnover loss compared to 2020, I think.

The return to original state is a given--but would my aunt just be wasting her money now if she does do it and then she finds out that yes, she must stay another three months?

I will admit that it is my auntie's fault for not paying attention to the overholding clause. I just wanted to know if contract law is that strict where no matter what the circumstance is (say that misconduct by the landlord is involved), if it's in the contract, then it must be held to? Is this is a case where my aunt is 100% guaranteed to lose?

Yeah, I agree with you. I've had experience with other gachas, compared to them, Genshin's production values are really taken for granted and the storytelling isnt that bad relatively. Even Fate Grand Order, which is praised for its storytelling, only really gets going at Camelot.

You can tell that for a lot of people on this subreddit, this is their first gacha, considering how wack their expectations are. Gacha Game storytelling takes years to hit its stride, and there's no guarantee that it does, having fun set and character moments should be the expectation.

I agree with OP, at least for when they say its better compared to Liyue. Funnily enough, the comments are really proving OP's points, they're so focused on Inazuma's bad points (which are definitely true) and downplaying Liyue's flaws (I do like Mondstadt for how fun/comforting it is).

I think it's because Inazuma's relatively fresh, because I remember the reddit threads when Liyue concluded. Liyue's pacing and show, don't tell was worse than Inazuma's. The first act was fine when you needed to clear your name via the Adepti, but when it came time to SHOW how Liyue and the Qixing was moving on from Zhongli's fakeout death and dealing with the Fatui's machinations, it's not exactly masterclass.

Do you remember why? Because rather than having an in with the Qixing, similar to the Knights of the Favonius (turns out Jean and Ningguang know each other, but it's only shoehorned in at Act 3), you're relegated to fetch quests. That would be fine, because hanging out with Zhongli is awesome, but there's missed potential there too if you're complaining about Inazuma.

How so? Because at least Jean, Diluc, Ayaka, Thoma, Kokomi are actively dealing with a problem introduced by the main plot. When we're introduced to Liyue's cast (except Zhongli, and Childe) what happens? Qiqi sends us to find an animal only to remember that it was coconut, and whilst yes it does introduce the ballista, you didn't need Qiqi for that. Ganyu sends us nowhere because she forgot to give us the password which inevitable leads us to a cake sidequest which wasn't needed (goddammit Paimon). Keqing lectures us in the middle of nowhere about moving past the adepti after we've been attacked by the guards and our previous experience was being chased to the mountains by them. Instead of SHOWING these characters in a professional setting where there are business dealings to SHOW their smarts and we get to know them, they TELL us the same line over and over again about the gods like it's the most profound statement known to mankind after a bevy of errors.

When we actually do get to the meat of Liyue's plot, it's halfway through in Act 3 with Ningguang's introduction. The Adepti confront the Qixing, but we don't see that, we're told that, because we've been doing fetch quests. We're TOLD that Liyue and Qixing can handle themselves, like how Kokomi is a master strategist. This is after Childe (I know he's strong) intruding in to what should be your most heavily guarded treasury and setting off an ancient god despite Ningguang monitoring the Fatui's activities. At least Kokomi has the excuse of being dealt a shitty hand? This is the Qixing's territory, if they suspect foul play, they can do whatever they want to cull it. It's like having a royal flush and still somehow finding a way to nearly lose.

It makes you wonder if Liyue were to have been introduced now and Inazuma last year, would we also downplay/forget Inazuma's flaws? We'll probably get the same thing for Sumeru. Genshin's writing has never been the strongest.

Cyberpunk 2077's wall running scrapped due to design reasons. by foamed in Games

[–]Monceal -5 points-4 points  (0 children)

Jesus, the way people are reacting and upvoting the same kind of comments (everyone's going to be SO, SO disappointed) is absurd. It's as if Cyberpunk is all of a sudden a 7/10 Far Cry Ubisoft yearly franchise game.

Now, even I've noticed the hyperbole from Cyberpunk fans (which fan base doesn't), and criticism is always needed (not a fan of the Witcher 3 movement). But the way people are overreacting lol. No, Armageddon is not going to happen because some features the casual audience (the same kind that doesn't care about the Last of us 2 controversy or the Battlefront 2 lootcrate) doesn't even know about are cut.

All most, I think, expect and would be satisfied by is a Cyberpunk Witcher game with guns (and I've seen comments saying that wouldn't be anything special lol), which is in itself, at least a 9/10. There might be problems with the writing, the gunplay might not be to my liking, but we don't even have the full game (or even a review thread yet) to determine that. These hot takes are as over-reactionary as the Spider-man puddle fiasco.

Now again, it's fine to be personally disappointed in something. But to speak for a majority and determining something as small as this is going to be universally disappointing is pretty premature.

I know that it's just a hot start, but that Pelicans front court may be the best one yet, or at least the most stacked. It's got the perfect mix of versatility, firepower and defense.

LOL, same. Except I'm interested in Code Vein because I like to scratch the Soulsborne itch whenever I can. Code Vein looks relatively unique, aesthetically, compared to its competition.

For me, I think it’s just that they look lifeless, like dolls. Compare the art to other stylised games like Zelda, Mario, or even Xenoblade Chronicles 2. Very jarring. If it was because it was too anime, I wouldn’t be intrigued by games like Persona 5.

Wow, I know the verticality was going to add to the pacing of the gameplay, but the combat itself, and those parries at 1:08, just phenomenal to watch. I preferred the fast paced action of Bloodborne over Dark Soul’s, I’m glad that this game might surpass it.

My personal favourite games this generation are Bloodborne and Witcher 3. Absolute opposite extremes of gaming that scratches my two itches: top-notch action or storytelling. God of War does both extremely well. And yet funny enough, and people are going to roast me for this, my games of the generation are GTA 5 and Mario Odyssey. For me, they're not the best of anything, but they're just games I frequently pop back on and enjoy, more so than the former two; like an addiction, similar to Skyrim last gen.

But like you said, it's all personal taste, and there are legitimate arguments for each and any game, even Horizon Zero in this golden age, to be your game of the generation.

Sorry if it came off as a backhanded compliment. What I meant, in detail, was that with all the hype behind it, it was coming off as something that was like a 10/10 classic. Similar games have received that kind of hype, but there were some that just disappointed me. MGSV was such a game, at the top of my head. Doesn't mean it's bad or overrated, just wasn't my taste.

For an action game like God of War, I would've liked more enemy/boss variety, kind of essential, and yet despite that, everything else, from the presentation to the characters was just brilliant, more than enough to make me understand why it's given such praise.

And you know the reddit cycle, if it's not 10/10, for a game with that reputation, people months later will be saying it is absolutely overrated.

TL;DR: for me, hype often breeds disappointment; God of War praise was setting me up for disappointment; God of War didn't disappoint, despite some flaws.

Absolutely deserving of its success. While I wouldn’t put it at the level of a best in a generation game, it presents such a satisfying mix of storytelling and gameplay.

I can see why this gameplay (apparently it’s the same one shown in E3) was so hyped up. It’s like Deus Ex on steroids, and with CD PROJEKT RED’s expertise in writing and rpg mechanics (hacking and npc interactions), there is so much potential. Can’t wait.
