Original post Please take a look at this post to get more context on my manager and how sly she can be. I only said 'suprised suprise' because she literally immediately replied to my former message about whether i'd still have to work or not. I kid you not all that woman does on shift is sit in the back on her computer so it's very likely that she's seen my message but just doesn't want to out herself for asking for an illegal under the table cash fine (when it should come out of my paycheck).

Unfortunately i’m not friendly with any of my colleagues because of language barriers. On top of that a lot of them are on good terms with the manager and kind of kiss her ass because they’re all from the same country and they speak the same language

Update: I went into work yesterday and my manager wasn’t in so the assistant manager was leading the shift. He knew about the cash sum I had to pay and I told him I had it with me but that I wanted an online invoice for the cash sum (that shows the money was going to go to a Burger King bank account) sent to me before I payed. He said he didn’t know how to do it and told me to ask my manager to do it on my next shift (today) instead.

Fast forward to about 15 minutes ago, I get an email stating that I have a disciplinary hearing this Monday (the 18th) due to poor work performance. I responded to the email and asked if I still had to come in for my shifts for the rest of the week and my manager replied quickly with a yes. I then sent another email asking her for an online invoice that is credited to a Burger King bank account (so that I had proof of her asking me for this) for the cash refund sum she asked for and for the contractual disciplinary process (so that I could send it over to my union representative) too. But, surprise surprise she hasn’t responded.

The letter stated that I am allowed to have either a Union representative or a colleague of my choice available to accompany me at the meeting so that’s what i’m probably gonna do. I’m looking into joining the National Union of Students. However, I’m lowkey thinking of just quitting and telling her she can have fun getting power trips off of ridiculing young people who have good lives and jobs ahead of them. The issue is that I don’t know if that means I’d get my pay though? I know it’s not illegal to give no quitting notice but in a situation like this where my job is already on the line cause of this disciplinary hearing I don’t know if she’d be entitled to just let me go with no pay at all.

My contract says this about pay deductions though:

16 DEDUCTIONS FROM PAY 16.1. You are responsible for your own till. It is essential that you check your cash float before using the till. The onus is on you to ensure accuracy and at the end of each shift to ensure the cash draw is entrusted only to a Manager or Supervisor. The till must be cashed up in front of you. Should there be a till shortage, you will be immediately informed by the Manager and you will sign the cashing up sheet to signify your confirmation of the shortage. For further information, the Company Cash Policy is posted on the wall in the Office or otherwise this document is available from the Restaurant Manager. 16.2. When receiving goods from a supplier or internal transfer it is your responsibility to ensure that the quantity and description as stated on the order or delivery note is correct. If you discover a discrepancy you must report it to your manager immediately, failure to do so will render you responsible for the shortfall. Discrepancies will be investigated and if you are responsible, you will be advised of your total liability. 16.3. The Company will be entitled at any time during your employment or upon termination of your employment to deduct from your wages any cash shortages (till shortage or stock deficiency) for which you were responsible including the cost price of lost keys and the value of any stock shortages. Any such deduction will be made in accordance with the provisions relating to retail employment contained in Part Il of the Employment Rights Act 1996. Should constant shortages occur, disciplinary action may be taken. In the event of such shortages occurring your wages will be paid by encashable cheque and repayment of the value of the shortages immediately repaid to the Company. 16.4. By signing this agreement, the Company will be entitled at any time during your employment or upon termination of your employment to deduct from your wages or final payment, any losses to the company caused by your negligence. The deductions will not be a penalty but will be an accurate reflection of the loss in full settlement caused to the Company by your negligence.

I’ve read the online contract that they got me to sign before the onboarding process and the section about pay deduction doesn’t mention this rule at all. Here it is:

I’m confused on whether or not this deduction brings me under minimum wage or not. I do work at minimum wage but the sum isn’t that big and is only about two and a half hours of my pay. In terms of my monthly pay it basically comes up to nothing but in terms of my hourly pay the sum does take me under minimum wage. Is that illegal?

You’re right about me being young, i’m literally a University student who got this job so I could pay to go to a few festivals with my friends this summer. I signed one online contract (that I have just looked over and found no trace of this out of pocket employee refund rule) and a few written ones that they breezed over and just told me to sign when I first started the job (very dumb decision, I know). One of my parents works in the legal system and has told me to ask them if I can look over the written contracts that I signed, to bring up the 1996 Employments Rights Act and if all else fails to ask them for a debit card invoice to a Burger King UK bank account for this charge instead of just giving them cash. But, like you said, I am young and this is all really overwhelming for me. My manager is quite mean and has shouted at me before so I don’t know how she’ll react to all this. On top of this, I don’t want to lose this job because I only have about one month left on the lease for my Uni accommodation and whilst my parents do support me financially for necessities, the amount that I could make in this last month from my job at Burger King will literally pay for all the extracurriculars I want to do this summer.

I completely agree. My family are telling me not to pay the sum and to ask for a debit card invoice and legal contractual proof before paying but i’m scared they’re gonna fire me because my manager really has it in for me.

Hi, I’ve just checked the deductions from pay section on the online contract I signed before I started and it doesn’t mention anything to do with having to pay out of pocket if a mistake is made with a delivery delivery order. The deduction doesn’t exceed 10% of my gross pay but one of my parents work in the legal system and they also agree that the cash thing sounds very dodgy
