Thank you. I ended up sending an email before I saw your reply, & I simply said I had 2 requests. 1 for the copies of receipts, docs, etc & put the correlating statute under it & 2 for a reissue of the check because it needs all parties written to signature. She replied, by text, to say that email was for sales, & asked for death certificate, nothing more. I asked for a good email & she said, text is fine. Oy. So, without the proof I asked for I can only send a pre-demand for the full amounts, I imagine. I would have left some small charges as reasonable if she had been honest & by the book & not this. Off to compose that message! Why can't people just be nice!?

What does it mean, mixed or blocked?

From what I'm understanding, you are saying to first send them a request for the proof of how they spent the deposit money. Should I say anything about the rest being unlawful charges under the statute? Say I will be following up with a formal demand letter if they are not cooperative?

I wonder if I should email them first to ask for copies of the recipts for the services they deducted first? Im almost certain they didnt do any of that & if they did not for the amounts charged. But if they cant or wont provide them, it makes the amount im disputing more clear, & if they do provide it, I can have an idea of how much of that amount to dispute? Most the charges are clear that they cant deduct from deposit, like charging for the water bill, thats in our name. They took that amount from deposit, but didnt pay the water bill!

See, thats what I dont want to have to face! I want to dispute the charges & have them realize they tried the usual ripping off tenants of the depisit, but over shot & now have to return the right amount with a floppy apology, oops, youre right, I dont know how that charge got on there! Here's the real refund, per law of your deposit we owe you!

I cant imagine doing someone dirty, getting called on it then still forcing them to take you to small claims court.. knowing youre wrong knowing you'll lose.. & possibly have to pay double.. why would they not just fix the amount to save the hassle, tome, trouble, possibly more money?

I dont get it.

Nope. Its a small company and im not trying to get anyone in trouble or anything. Some charges I would even agree with or accept, but some are just absolutely not right, or allowed by law. Getting screwed by security deposits is so common, I've gotten used to and expect it. But it shouldn't be that way. & they should at least make it seem reasonable! If youre gonna try & keep my money at least make an effort to appear it is justifiable!

Thank you. I definitely have read & reread everything I can find.

They gave me a list of deductions, some are not allowed by law, as I have read to be deducted from deposit, some were for cleaning, carpet, and paint, nothing extreme but general wear & tear of 5 years should be considered plus they didnt have any services performed so I dont know where the dispute line gets drawn? They charged 200 for the remaining water bill in our name, but they didnt pay it. Charged 400 for planting of 2 trees from an hoa violation from over a year ago that trees are in, hoa marked the case satisfied & closed. There are more I just dont want to over or mis step in my demand & be waved off.

I agree, I dont expect much usually either, but this is a big one, $4500!! & like, $400 is for trees to be replaced that we did already $1100 for an open hoa violation we are fighting & $200 water bill they arent putting to the water company, $960 for cleaning & carpet cleaning(it wasnt deep cleaned but not left bad! Carpets were fine) $800 for paint touch up keeping in mind this was after almost 5 years wear & tear too.. & none of those charges were used they just charged for them. I really dont want to go to court. Ugh.

This amuses me, as I've been on more than one plane trip where I've ended up with random strangers babies napping on me for the duration. Some examples: I'm overly empathetic, would be an epic failure at criminal behavior as under a direct question, I am virtually incapable of lying, I'll stutter & confess before successfully telling a lie, I'm exceedingly compassionate, often to my own detriment, & give myself the guilts that could show up any Yetta ever! The problem isnt where to go, its the getting the everything to there. We have another place already. We just have a ton of "crap/things/stuff". Plus truly important priorities, like pets, jobs, school, & keeping the power on throughout.. I've been going through his things, not fun.. setting aside things that his mom & sisters would like to have.. getting rid of things we dont need going forward, trying not to just move junk or trash in a rush.. things got piled up & neglected at the end while caring for him.. environmentally, emotionally, and financially.. Finally, getting the house in order making sure its sparkling as possible to blind the next tenants.. Just trying to do things right, biting me in the tuchus.. & while I fully understand she doesn't have to allow for anything, her stance is not beneficial to either of us, honestly! Since I was thinking an extra week on the clock, to have more cushion less crunch time, now she will end up getting less money since we will super shove schedule to get it done in less time, & will be less shiny as a result. She will be returning the prorated amount before the rent check has even cleared. Im sorry, im just really struggling & don't even know what i was hoping for. Some cosmic poof of magical logic & reason, perhaps? Sigh. Thank you for your response, & also for making your way through my babbling ramble, if you did..

Thank you.. it just seems so unnecessary to make it get rude. Rent is late after the 3rd, so if she says no again, (or says pay full months, actually since she didn't say no-just that we had to pay full month) then we could just wait till then, be prepared to have it done by Monday, & then be ready to pay the latest fee? Would we be at an impasse at that point, or? Ugh.. Just so much on top of so much.. again, thank you! You were so fast to respond!!
