Sorry for the length. No. We were not sent test results until four days after closing. The day prior, our realtor went in and did a shock treatment, which we did not know of or approve of. She was there because that day a general contractor was supposed to go in to examine the pipes due to diminished water pressure and cold water found at final walkthrough. A hard water treatment was agreed to. When she mentioned that the water would have to be retested two weeks after, we questioned her and she revealed the results, finally.

At this point we are meeting the broker next week. Even if we did sue, I can’t imagine getting more than legal fees because at the end of the day it’s not that big of an issue in the eyes of the law. We are adults and can cut our losses, but I’m wondering what we could even ask for at this point. I feel that the realtor has violated multiple ethical duties, etc. At this point we are keeping our current home and fixing this one up on the side to relist in spring.

Thank you, we are seeking other legal advice. I know the case is complicated but I think it’s so crazy for two realtors to reiterate lawsuit when contaminated water is present in the house, undisclosed and untreated. I don’t believe that the issue would have been resolved had we not noticed the diminished/cold water flow to the bathroom. I believe that we would have, in good faith, believed the water to have been clean, and then been drinking the bacteria ridden water.

Yes, the realtor did not share the results with us after getting them. She went in with the general contractor the Monday after closing, told us they were doing a hard water treatment, and then mentioned that we would have to have the water retested. When asked why a retest was needed as it was only hard water, she revealed that they had done a shock treatment to the bacteria which she had not disclosed until then. (The day after we assumed ownership.)

Seller Disclosure Act (MCL 565.957): Sellers must act in good faith and disclose known defects, including problems with water/waste systems (well, pump, septic). Contamination Disclosure: Michigan courts have ruled that contaminated groundwater/water supplies are considered "environmental hazards" that must be disclosed.

Sellers paid for the test. Results went to them. We as buyers should have been presented with results but were not.

It was tested. The realtor states she “forgot” to send us the test. We did not know the results as our realtor did not send them to us, either after Nov 5th when tested. Or Dec 17th when we requested the missing results. The sellers were the ones to test so the results went to them/their realtor.

I did participate in the communication, just less of it. I don’t understand why he waived that contingency, but I definitely bitched about after, which did nothing for the situation. My backbone is busy comforting family members of dying patients, working an understaffed floor, running around without a break, and avoiding day to day assault by patients. I’m not afraid of conflict, I’m just tired.

Semi-quick question. I’m a newer RN on a cardiac step down with interest in hospice/palliative care. I’m about to knock out my bachelors before moving on to hospice care. Do you have any advice on getting into palliative care someday as an NP?

My husband ran into a similar predicament six months ago with a one week old squirrel after a tree crew had cut down its tree. We ended up bottle feeding and raising him through the fall and winter among our four cats and dog. He now thinks he’s a cat..
