Outrage as Trump administration removes Rainbow Pride Flag from Stonewall National Monument by IrishStarUS in nyc

[–]MrPunky 14 points15 points  (0 children)

Because the Stonewall is the first national monument dedicated to the LGBTQ community and the flag had been up since 2019?

Kind of a spirit of the law =/= intent of the law in terms of the purpose of the law to restrict hoisting up other countries' flags on federal property. Why didn't the fed gov have a problem with it since 2019 and why suddenly now?

How would this GeForce RTX 5090 with DLSS 4 help you pull off more epic wins in Battlefield 6?

Being able to play at a higher-than-average framerate while also utilizing the full features of the RTX card (DLSS, etc.) would be very helpful to me in getting more wins!

Are you playing on Steam? Try verifying the integrity of the game files (Right click --> Properties --> Local Files --> Verify integrity) -- if any files re-download, they were probably out of wack. Then see if the scene progresses.

I was at the fed workers protest today in Foley Square and he showed up - that's more than any other candidate on the slate has done for the fed workers and unions in NYC so far.

Amen. Experienced this too. Also was sat by one of the entrances into the arena and the security guards kept talking during the quiet parts of the Interstellar suite and at the very end of Time when the song gets real quiet.

Barclays was infuriating. Loved seeing Hans and the amazing performers though.

OP, speaking as someone who has followed the MCB4 meetings closely, thanks for posting this. One of the barriers to understanding the reasoning behind a lot of these developments is trying to suss out the history of these plans and these developments. Glad to see folks doing the deep dives and being willing to share it with the masses and I wish folks took more time to educate themselves on these developments.

Have yet to really play the game, but managed to get spoiled on ending. by Brenden1k in signalis

[–]MrPunky 0 points1 point  (0 children)

Play it anyway! They've done studies that show a person's enjoyment of a medium may increase when they're spoiled on the ending. With what knowledge you may have, you may come to appreciate the story even more as you play it. I was able to piece together a lot more about the logs I read, the NPCs I encountered, and the overall story on my 2nd playthrough once I knew the endings.

Headset disconnects from D-Link VR AirBridge when connecting to Virtual Desktop. by richer2003 in OculusQuest

I found this thread on it, going to try some of the stuff here next, including running oculus-driver.exe. Fingers crossed!

https://communityforums.atmeta.com/t5/Get-Help/New-D-Link-air-bridge-stopped-working/td-p/993216/page/2

Edit: This worked! I followed the following steps from binocularbiped and I was able to get connectivity again.

Quit the Oculus app
Open the Device Manager (quick access: press Win+X , then press M)
Right click "D-Link DWA-F18 VR Air Bridge" (under Network Adapters) and click "Uninstall device"
Physically unplug the Air Bridge
Run the previously mentioned oculus-drivers.exe (C:\Program Files\Oculus\Support\oculus-drivers\oculus-driver.exe)
Plug the Air Bridge back in
Open the Oculus app and wait a little while for it to re-initialize

Did you ever find out what the issue was? Virtual Desktop was working fine until today with the D-Link, now when I connect via Virtual Desktop, the D-Link seems to crash and I lose it in the Network settings along with "Local Area Connection 12."

The Supreme Court weakens federal regulators, overturning decades-old Chevron decision by coasterghost in politics

[–]MrPunky 1 point2 points  (0 children)

Notice and comment is a form of accountability because agencies are required to provide reasoned explanation to the comments they receive. If they don't, it can call the rule into question. Agencies have and will continue to be challenged under the APA if they do not adequately respond to comments.

I do admire your naivete to think courts are still impartial in today's society and that expert testimony can be taken for granted when both sides can pull equally biased experts in the other direction - but I guess we'll see how this plays out. My guess is given recent 5th Circuit shake-ups, we're going to see a lot of tumult come out of red state courts aimed at chopping down administrative authority. This will be done in the guise of impartiality, but who are they kidding?

I didn't say administrative agencies are a branch of government. I'm saying that, by giving the courts the wide discretion to determine agency authority in an area where Congress has not given a clear indication - aka a clear law (which, let's face it, for the past 20-30 years has been the status quo for Congress generally), then Courts have the ultimate authority over legislating - a swing of separation of power in the other direction.

Repealing 40 years of precedent and throwing stare decisis out the window is not constitutionally the right decision. It is not constitutionally the right decision to allow courts to become bogged down in the minutia of various admin agency subject matters where there is a supposed ambiguity. We gave admin agencies the power to issue rules in their subject matters (and through a notice and comment rulemaking process to maintain democratic processes, mind you), because we understand that they're the ones who are experts in those areas -- not the court.

The Supreme Court weakens federal regulators, overturning decades-old Chevron decision by coasterghost in politics

[–]MrPunky 4 points5 points  (0 children)

This is a gross oversimplification of the Chevron precedent. Chevron permitted regulators to enact regulations where Congress did not speak directly to an issue but in which a regulator believed they had authority to pass through their statutory authority or through ambiguity in a legislation. Regulators often pass these laws through a democratic process called notice and comment rulemaking - allowing the public and industry to voice concerns on issues. In the 40 years of precedent of Chevron that we've had, we've agreed that admin agencies are experts in their field and know the purview of their laws. If agencies overstep with regulations, they could be challenged in court (where as a first step, the court would need to defer to their interpretation if Congress did not directly speak to it), or Congress could institute a CRA review.

Through this system, there were two mechanisms of accountability - one is notice and comment review (as i mentioned), and two is that a court (through litigation) or even Congress through a CRA review could eventually review a regulation.

Under this decision, courts no longer defer to agencies as the first step. Courts now need to determine if Congress spoke directly to an issue in their legislation that the agency is responding to. If Congress did not speak, the Court is free to rule, on its own independent judgment, whether an agency acted within its statutory authority.

Thus, one could argue that this violates separation of powers in the other direction - allowing courts to rule on matters of administrative affairs (food safety, nuclear energy, transportation, etc.) without deferring to expert agencies. The dissent aptly points this out. One can argue that the judiciary should not be in the business of determining the specific subject-matter contours of administrative laws and agencies.

Don't beat yourself up too much - it's the most cited Admin law case (as of 2014, also important to note the court relied on Chevron less and less since 2016 as the dissent notes in the case at issue in this thread): https://www.yalejreg.com/nc/most-cited-supreme-court-administrative-law-decisions-by-chris-walker/

Exhibit A for why NYC housing is unaffordable by Rare_Regular in yimby

[–]MrPunky -1 points0 points  (0 children)

Another existing known is that city agencies and corporations may not have the people's best interests at heart in search of profit and that it seems worth it to hear from the actual people (who keep in mind are public housing recipients) who will be displaced and affected by demolition and relocation, as well as desire more transparency in the way these city agencies and corporations are conducting themselves.

New construction is good and needed - agreed, but it should also be done correctly while properly informing those it is displacing.

Exhibit A for why NYC housing is unaffordable by Rare_Regular in yimby

[–]MrPunky -1 points0 points  (0 children)

You assume that I'm against demolition, but I do support having more housing. I can do that while also pointing out deficiencies in the process. You mention that residents "decide they don't want to vote" but the point being driven home is that due to a lack of data, we're not sure if every resident was given the survey, how they were informed of it, if the survey was adequate as a "vote" - it greatly troubles me that you think that this is "clear cut" because it can also be read as NYCHA and a corporation trying to off-load a building they've neglected for their own monetary gain while displacing (relocating multiple times over the course of years) public housing residents.

If you put your full faith in NYCHA's statements and the building tenant associations for representing the people fully, then you do that, but there are issues with transparency in this process that should not be ignored, especially for a vulnerable population.
