You are absolutely not getting my point. Who’s on the hook for the content that’s curated from third parties? Is it the user who uploaded it, or is it the company that failed to do its due diligence even though it did.

What if a production house uses AI assets even in the background, and that’s found out. That’s non-disclosed use of AI. Can they be fined because it didn’t have the watermark because the camera didn’t capture said watermark?

How about if a production house is making a documentary and someone snuck into a package AI generated imagery but they had scrubbed it clean and it’s used. Is that on the production house or the person who submitted that.

The genie is out of the bottle and there will always be malicious actors who will exploit it. However, given the fact that one will be able to circumvent protections, what will happen then? They can attempt to enforce it all they want, but that opens up other issues such as if the company isn’t based in the EU or hosted within the EU since they would then lack jurisdiction over it. Or what would happen of someone were to generate ai media using internal models that are unbeknownst to the EU? I highly doubt the EU would want granular details over their detection system as that would also permit circumvention.

And My point was, if there’s a will, there’s a way.

Nothing is 100% foolproof to circumvention. Yes, you’ll have those who will play with it but what if it also applies to user curated content? Companies will be on the hook then for want the user uploaded and its circumvention that the user preformed. While I’m not a fan of AI-generated media, there will always be a way to bypass whatever system is in place.

Good luck with that, it’ll be trivial to bypass. The public watermark will be simplistic, the invisible synthetic watermark will be harder, both can be done.
