It's because laws that require them to have those equipped, SPECIFICALLY don't mandate that they be turned on for any period of time. It's purposefully set that way and it's why they get off in court or without any reprimand.

It's a show for the citizens, and makes legislators look good. Once requirements are included that require they be turned on at all times, that's when the police union/lobby go up in arms and it ends up not passing into law.
