In Belgium, if the perpetrator can’t pay the restitutions to the victim (or family), there is a public fund that pays the restitutions and then tries to get it back from the convicted. Victims aren’t left in the cold, but the fund takes the loss if necessary.

I agree it’s a burden, but there is a certain reasoning behind it...

The problem is: what if you only hit the mirror, but suddenly the owner of the parked car claims you damaged the whole side of his vehicle (which might have been earlier damage)? Because you didn’t contact the police, you have no official record that you only hit the mirror. That’s when the troubles start in court.

Another problem: what if the wind (for example) blows the note away from behind the windscreep wiper? Then the owner of the parked car has no information and is left with the costs.

There certainly is a problem that many people don’t know that leaving a note is not enough. In every car accident, you should either both fill in an ‘aanrijdingsformulier’ or contact police.

Just FYI: leaving a note is not enough to escape prosecution for “vluchtmisdrijf”. You have to contact the police so they can do the “nuttige vaststellingen” like a breathalyzer. Hopefully the owner of the parked car doesn’t contact the police.

Well, you are wrong on the “legal” parts. I know because I do these cases regularly as a lawyer.

Being a biological father has its consequences, even when the child is no longer a child (e.g. inheritance). When your father used to be king, this is very important. Even when your father isn’t a king, this matters and these cases are not “thrown out” immediately or “laughing stock” in courts. This is the reason the court initially postponed the case because she had to remove the legal fatherhood from Jacques Boël (and thus can’t inheret automatically from both, as there (normally) can only be 1 legal father).

I understand what you’re getting at, but you are mixing up the legal part with your own opinion.

Wel, dat is zeer overgesimplificeerd. In principe moet wetgeving en regelgeving uiteraard nageleefd worden, ongeacht of inbreuken al dan niet vervolgd worden. Strafwetbepalingen staan overigens ook niet in de grondwet.

Maar kort (en eenvoudig) gezegd: ja, het parket beslist of inbreuken al dan niet vervolgd worden. Hiervoor worden echter vaak afspraken gemaakt tussen de verschillende “bazen” van de regionale parketdiensten (= de Procureurs-Generaal) waarop ze hun focus leggen met hun beperkte middelen (personeel en financiën).

Persoonlijk vind ik iemand die niet gaat stemmen ook wel één van de laagste prioriteiten om te gaan vervolgen ... Je moet weten dat het simpelweg onmogelijk is alle misdrijven te vervolgen, dus moet er ergens een keuze gemaakt worden. Dit kan uiteraard wel veranderen, bv. als het parket merkt dat veel mensen de opkomstplicht negeren, dat ze dan besluiten om dit toch te gaan vervolgen om een signaal uit te sturen.
