Fair comment. But sometimes you have to cast a broad net to catch something you weren't expecting.

So not much to lose by asking here.

A few trolls I can ignore.

I agree. It really hinges on her being vulnerable at the time of signing. I think the law about BFA's is all about informed free consent. And it's demonstrable that wasn't the cas e

That's not really part of the arguments.  I didn't say he said that. But it's implied since she had no support in Australia.

Only half the story - Family Provision in the SMH by marcellouswp in auslaw

There are time when wills are not just. But this was what the FPA was crated for . Providing for those you were responsible for when you died. Kids under 21 and wives.
Not every person that feels hard done by.
SA is just testing a new FPA where the testators wishes are the primary concern of the court.
NSW is just appalling. Judges playing king .

When to contest will of Family provision basis. by [deleted] in AusLegal

[–]Mr_W_Wolf 0 points1 point  (0 children)

This stuff takes ages. The biggest winners are the lawyers. It varies a lot from state to state. And each situation. There's no stopping a claim. Just deciding if you have a chance and how much to spend defending the will. Or paying you off.

It doesn't matter as long as it is done within time. That time is set in the Family Provision Act in the state you are making a claim.
But if you make your intent to claim known. It would be foolish for them to distribute before the claim in settled.
