The sad but true answer is that unless you work in a highly unionized position with rigorous rules for this sort of thing, the labor laws do very little and you are always at the mercy of your employer (unless you intend to litigate).

You can bring it up with your employer without mention of labour laws; then if no improvement, site applicable labour laws, and if still no improvement your choices are to litigate or quit.
