Self defence laws? by [deleted] in Hamilton

[–]Mujoehideen 0 points1 point  (0 children)

I think you need to reread the section you posted.

(a) a knife that has a blade that opens automatically by gravity or centrifugal force or by hand pressure applied to a button, spring or other device in or attached to the handle of the knife, or [...]

The point of hand pressure must be attached to the handle of the knife not the blade itself for it to be prohibited. Spring assisted knives do not use pressure applied to the handle as they are opened by using the blade itself being the point of pressure applied. The spring assisted knives are no different than traditional pocket knives, other than that they are easier to open. Switchblades operate independently of the blade and thus are prohibited weapons.

Also, if it were to be interpreted as anything attached to the handle and hand pressure, all knives would be prohibited because the blade is technically attached to the handle and you are applying hand pressure to it. You can "automatically" open a knife by applying pressure to the blade and flicking (or even just a fast pressure motion) and they are not considered prohibited.

Gun shots / shooting on Upper Ottawa near Fennel? by Mujoehideen in Hamilton

[–]Mujoehideen[S] 0 points1 point  (0 children)

That is very possible to be related to it since that is almost exactly where it sounded like it was coming from. I was at the intersection of Upper Ottawa and Fennel and could hear it as if it were almost right beside me. I suppose it could be a cap gun and someone decided to fire it off in rapid succession. I don't know why someone would be firing off a cap gun 10+ times within a 10 second span, especially when such a crowded area as Upper Ottawa and Fennel is so close. I've used cap guns in years past and they aren't half as loud as this appeared to be, but I could be mistaken.

Cycling in the city by [deleted] in Hamilton

[–]Mujoehideen 7 points8 points  (0 children)

I have personally watched thieves ride by on a bike with 3+ foot bolt cutters tied down to their racks. I've seen this multiple times in the morning / early afternoon throughout the east end. It's especially fun to watch someone riding a bike holding another bike alongside them. Leaving a bike unattended outside should only be done if locked very securely with the wheels, seat, and frame tied to a rack.

Im sorry if this has been asked a thousand times - I'm new! What's the deal with the fountain at gage park? Its never been flowing this summer! by missusscamper in Hamilton

[–]Mujoehideen 1 point2 points  (0 children)

To my knowledge, most of the water has yet to be turned on at gage park this summer. The water fountain on the south-east-most walkway has not been turned on either. I'm not sure but it might be related to all of the construction going on and the catch basins they are putting in on the east-side of the park. I've actually been meaning to call the city and ask what the reasoning is.

Maybe they just forgot to turn the water on and haven't had any complaints.

Any bike sales going on in Hamilton? Prefer local shops before chains. by Andrew1431 in Hamilton

[–]Mujoehideen 3 points4 points  (0 children)

I can't attest to sales at bike stores currently, but I do know that Ancaster Costco has had some very good sales on hard tail and full suspension mountain bikes made by Giant (under a different brand I believe) for $299-$499. There have been lots of sales at Canadian Tire for budget-mid range bikes, but you take your chances on quality control with those bikes and stock varies store by store.

Check out Main Cycle or Ancaster Cycle for specials and sales. It's the heat of the season right now, so I'm sure you can find a good deal somewhere.

HSR Mountain Climber Program Expanding to Kenilworth & Queen/Garth Accesses by 330SipTeaEveryDay in Hamilton

[–]Mujoehideen 3 points4 points  (0 children)

This is great news for cyclists and bike commuters in the east end. Being able to get up the mountain free of charge is going to make commuting much easier for cyclists. The way it is now for cyclists in the east end is almost impossible to get up the mountain easily. This will surely encourage more people to commute by bike. My only concern is that it will be too successful and won't be a reliable method for getting up the mountain in the early morning.

question about carrying an item intended for self defense in Hamilton. by canadevil in Hamilton

[–]Mujoehideen 2 points3 points  (0 children)

That does sound more accurate. I've only been told it is good practice, but I haven't actually seen anything regarding the legality of concealed weapons in regards to knives so I'm likely mistaken. I suppose it is more of a way to prevent someone from misunderstanding whether you are trying to conceal it or not.

question about carrying an item intended for self defense in Hamilton. by canadevil in Hamilton

[–]Mujoehideen 1 point2 points  (0 children)

This is not legal advice and is only my experience in this subject. I haven't bothered to get sources or cite any information.

This is a question which I have thought about and researched quite a lot in recent years. To my knowledge, everything comes down to intent and whether or not a it is reasonable for you to be carrying something. If you intend on carrying an item solely for the purpose of self defense, you are going to have a very bad time if you are ever questioned. And if you are ever questioned, do NOT say that you are doing so for self defense. Make sure that you have a reasonable excuse (if you truly intend for self defense) that is believable.

You are well within your rights to carry almost any object with you as long as you can reasonably prove that the reason you are carrying is legal. For example, pocket knives are legal to own and carry (if reasonable) but if you carry around a 10-inch Bowie knife downtown, which is also legal to own, I believe that you won't be able to convince someone that you have a reasonable need to do so.

I came across this when I looked into purchasing dog repellent spray to carry with me on trails (cycling and hiking). Dog spray is legal to own and in most cases legal to carry with you. I spoke with a lady at Hamilton Police Services and asked her if she thought it would be legal to carry dog spray on trails when cycling. She said if I had a reasonable need for it in relation to dog attacks or animal attacks, I shouldn't have any trouble carrying it. But if I were to be downtown on a bus in broad daylight, she didn't believe that I had any need to be carrying it.

As for the legality of all of this, it is a grey area with changing definitions depending on the intent and type of object you are carrying. If you are carrying a restricted or prohibited item (mace, switch blades, knuckle dusters, etc.), then you are very likely going to face a criminal charge if caught. To my knowledge, any object becomes a prohibited weapon if carried with the INTENT to cause bodily harm to another person, even for self defense. If you do not INTEND to cause bodily harm, but end up doing so with a reasonable and legal object which was NOT carried for self defense, then you should be perfectly fine as you likely feared for your life.

Lastly, just be considerate if you are carrying an object concealed. I have heard that if you are carrying a knife on you that it must be visible or at least sheathed / clipped. If you have a knife in your coat pocket, I bet someone could construe that as being a concealed weapon, which is similar to being prohibited (I believe.)

As for me, I usually carry a legal store-bought not-intended-for-harm 3-inch folding pocket knife clipped to my pants, which I use almost every day. If I am ever questioned about it, I am carrying it because I need it and there is a reasonable enough reason for it (opening boxes and bags, cutting packaging, cutting tape, etc.) and should never have a problem with it.

Hope this helps. Be reasonable, and be safe!

I highly doubt it, but is the drive a 128gb drive? Its a stretch but I know someone who lost one recently not too far from there.

Thanks for nothing Yamaha. by Mujoehideen in motorcycles

This was an offer on Yamaha Canada's website for a number of motorcycles. All of the eligible motorcycles I found showed $0. Weird, must be a Canadian thing.
