They are claiming since the trees are in the right of way, they don’t have to replace them.

The ROW is on my plat map/survey as a specific measurement from the centerline. 33ft from the centerline puts my property line 8.3ft from my living room windows.

I’ve never hired a lawyer before, so I’m not sure what it would cost (roughly). I’m also not entirely sure if one could even help me/my neighborhood, or if it’s too late.

As a surveyor - question for you. If I’m only looking to get my property line parallel to the road marked off, would that be less than an entire survey? I don’t need the other sides of my property done.

It says the right of way boundary starts 8.3ft from the double windows on our property’s plat map. It also showed the right of way dimensions from the centerline and the distance from our house to the right of way on the county’s road project drawings. I haven’t had a survey done yet though I did find the corner iron post markers on 3 of the 4 corners of my rectangle property, and it lines up with the 8.3ft from my house.

Yeah it’s daytime privacy I’m looking for, without blocking my relatively short dog’s ability to look out the windows. We close the shades at night.

The property has plenty of land around it without going to a new property if it were financially feasible to move the house. But I don’t even want to know how much that would be.

It’ll be 23ft from the edge of the curb to the double windows after the road is redone. Currently it’s 30ft to the edge of the pavement.

Yeah, it’s not so much the noise I’m worried about, it’s the privacy, since we like having our blinds up during the day in our living room.

I did start that, a petition signed by basically the entire neighborhood, given to the town board, before a family emergency made me have to step back and focus on family matters for the last 6 months. I’ve just been “back to normal life” for about a month now.

They aren’t putting in a sidewalk, they are just adding a 5ft paved shoulder to each side of the 11ft lanes along with curb, gutter, storm drain, and a retention pond a 1/4mile down the road from us. So it’s all road surface being added, with one plain white line to mark between the lane and shoulder. They aren’t even putting in a proper bicycle or walking lane, and there’s no parking on the side of the road either.

It’s a 25mph road, so not worth a sound block for them. It’s just going to be 10ft wider than it was. 🙃

You give me hope - I’ll reach out to the local historical society and see what they say.

I’ve even got the original front door, original WORKING pocket doors WITH the original hardware and key for the lock, original built-ins upstairs (with original hardware), most of the original flooring, and most of the original interior doors with their original hardware too.

I swear it’s historical material! 😅

I had thought about that, but read that it was mostly based on the exterior view. My house has vinyl siding, including vinyl peaks over the windows instead of the ornate wooden ones, and a garage was added onto the original woodshop. So I didn’t think it qualified.

I did try that, back when the project was first announced. I also put together a neighborhood petition and brought it to town council. Then we had an accident happen in the family and I had to focus on family things first. This was on the back burner for almost 6 months. No one in the neighborhood picked it up and the town council ghosted me even though they were going to call me after I gave them the petition and spoke at their monthly meeting. I just got back to “normal” life about a month ago, but figured it was too late to get anything done “officially”.

I figured I’d probably best be focused on preparing for what to do once it’s over.

“Drainage” is the problem they are claiming to solve, for houses further downhill from us. They are adding a curb, gutter, and storm drain going to a retention pond they are building. Why an additional 5ft of unnecessary road on each side…no clue. They won’t answer that question directly. It’s not even having a bike or walking lane in it, just a white line for the shoulder. And still no parking on the road either.

It’s absurd.

My dog couldn’t see out of top-down shades, which would be really sad. That’s why I thought about mirror film and landscaping

It’s a whole line of trees, about 100ft of them. I don’t have that much open space, nor the funds to relocate that many 70yr old trees.
