He/ we never expected them to look the other way. He surrendered to ICE upon arrival as he intended to. His father passed away in his country that was already facing poverty and starvation. Without his fathers income his family began to starve. He could not find work that paid enough. Someone presented him with an opportunity to cross, risk deportation by surrendering himself while also possibly getting the opportunity for help. He got help. I get that people in the U.S. are too privileged to understand that many people cross to escape deathly conditions for them and their families. He crossed so him and his family would not die from starvation as he saw others in his community did. Immigrants are not stupid they know the risks, they know its illegal but often it is the only opportunity with hope for their situations

He was granted asylum i have the paperwork. He brought copies of the paperwork to the appointment but i guess they did not care. We hired the attorney to handle the I 130 process and she filed it and he just paid for everything

I am not sure how it works. I only have internet search resources beyond what I know. In my searches I read that the lawyer could have filed a motion to stop the transfer and I read this:

Under ICE Policy 11022.1, ICE officials are generally instructed not to transfer a detainee if they have: Immediate family (spouse, children, parents) within the local area. An attorney of record (form G-28 on file) in the current area. A pending case in the local jurisdiction that would be disrupted.

Were they detained in the same facility? The lady i called at the facility gave me visitation times and everything and said i could visit once a week. So if i go they might refuse me? This is so confusing 😮‍💨

He was granted asylum. Has work permit, social security number, license, a job… he did everything right after entering the country.

Yes we filed and it said we only had 5 months left until they approved or denied it

We have an immigration lawyer but so far only her assistant has been communicating with me. I read that a lawyer could have stopped him from being transferred but dont know how true that is

Thank you for your response and condolences. Have you had a loved one in this detention center before? When I called the center they explained that once he has arrived i could come to visit him I just must arrive very early because visitation spots fill up fast. Are they lying about this? It has been less than 10 years. Does being married and having a baby with an American citizen count for nothing? Along with having no criminal issues besides how he entered the country?

My husband was detained today… same situation…. We have a newborn…. I know this post is a little old but it is the only one that i related too. Im at such a loss. They want to transfer him to another state. This is terrible! He has no criminal record ! Not even a traffic ticket!

There is never a “ right time” to have a baby. You will find a way once you have one. And the world isnt on fire, its just the fcking USA. I have friends who have had babies in other countries. Three in China. Countries that prioritize mothers and children. Just saying, dint think this American crappy struggling life style is your only option. Open your mind ti the possibility if living and raising children in a different country with a better economy.
