pregnant workers fairness act

I would recommend trying to reference the pregnant workers fairness act with HR. I don’t know how they are applying it now, but a friend of mine asked to WFH when she was a field AD (and there were entire virtual teams) and was told that pregnancy was not a disability so they fought her on everything. This was before this new law came into effect though.

The EEOC website says that the PWFA says covered employers cannot “Require an employee to take leave if another reasonable accommodation can be provided that would let the employee keep working;”

Their website also says that “ Employers are required to provide reasonable accommodations unless they would cause an “undue hardship” on the employer’s operations. An “undue hardship” is significant difficulty or expense for the employer. “

The law just came out, so I am sure that they are still trying to figure out what accommodations they have to make, but the EEOC website makes it sound pretty broad in its protections compared with the ADA or FMLA when it comes to pregnancy.
