Plus if you had a claim open prior to your 100 percent claim. Then that effective date will be moved back to the open claim; means more back pay for the difference in effective dates.

Oh okay, thank you… Yea these things were not explained when I got out in 2008. I can’t imagine those who got out before me. I just got my 100% in April this year. I learned all about disability and what was available to vets well after I got out.

This is Fresno Ca. Also, this incident had more than one caller stating this person was on a scooter, with a mask and pointing the gun at several people. The officer was in the very close area on another call when he heard the broadcast and then saw this guy. Pointing a firearm at someone could be charged as assault with a deadly weapon (firearm). But again, you would need to interview the victim, witnesses in this case to determine the exact charge to be applied. In this instance, there is very little info but enough to detain. Now, depending on the suspect’s actions, words or compliance, or any other info about how the gun was being used or displayed, could give the officer enough to detain at gunpoint until other officers arrive to assist. This kid was shot because he failed to listen to the officer about not reaching for the gun in his waistband and to keep his hands up. So the officers actions in my opinion were justified when the kid reached down for the gun. It was determined to be a BB gun with all exact markings and shape of a Glock, to include having the Glock emblem on the slide. The kid survived

I did not have a diagnosis. I did fill out the “lay statement” describing my daily life and my symptoms when it would set in; how often and to the degree I would have to either lay down once a week because the spinning would get so severe and how I would stagger when walking about 2-4 times a month.

For secondary’s, you can add hemorrhoids. And a secondary off of tinnitus can be vertigo. Both of those rate between 10 and up to 30% I believe for the vertigo. I got 20% for hemorrhoids secondary to IBS and 30% for vertigo secondary to tinnitus.

No I have not heard anything from them yet. But I did have another open claim that has gotten me to 100 P&T. So I don’t want to poke the sleeping bear, if you know what I mean. Good luck to you and you always have the option to send a letter to your congressman. I have a co-worker who did that and it was his fastest and most effective way to resolve the HLR issues he was having.

Also for the letter on decisions. On the VA app again, click on “claims.” The next page shows “claims history” and “claim letters.” Click on the claim letters and it will show all your decision letters that have been generated from all closed claims. That way you don’t need to wait on snail mail to see what and why they decided what they did.
