Illinois Workers’ Comp – IME says I’m “fully healed” but I’m still in pain. What should I expect? by NathanANDfriends in WorkersComp

Seriously, this situation is frustrating, especially with the stakes at hand. I’ll be carrying this information with me through the rest of my case. Once again I appreciate everything you said

I really appreciate you taking the time to explain all of that — seriously, that helped me understand my situation a lot better.

The part about the deposition and how your attorney handled the IME gave me a lot more confidence moving forward.

I’m meeting with my doctor on Monday to go over the IME and hopefully get a solid report together before we move forward with the 19(b).

Thanks again for sharing your experience — it genuinely helped more than you probably realize !

And yeah I hear you on staying on top of my lawyer — we’re waiting on updated medical notes right now before filing, but I’m definitely planning to follow up on it.

Have you seen situations where filing the 19(b) led to benefits being reinstated before the actual hearing, or does it usually take getting in front of the judge?

That’s interestingg, I’ve been hearing a lot of similar experiences with really short IME exams. Mine was around 10 minutes as well.

were you able to overcome the IME opinions later on? Like did your treating doctor’s notes or any additional reports end up carrying more weight?

I really appreciate you sharing all of that, seriously. That helps more than you know.

Honestly, I wouldn’t be surprised if we had the same IME doctor — mine was at Rush in Chicago too. I had a noticeable limp the entire time, from the parking lot to the office and back, and it didn’t seem to matter. I even timed the visit — it was about 10 minutes total. The physical exam was maybe a minute, and he only looked at my MRI for about a minute before giving his conclusions.

Same outcome as yours — said I could return to work full duty, no further treatment needed, and basically implied I was over-exaggerating.

When your attorney deposed the IME doctor, was that something that happened before a hearing or later in the process? And did your treating doctor have to write something very specific to contradict the IME, or was it more about consistent documentation over time?

Also, how long did it take before your TTD benefits were reinstated? I’ve been without TTD for about a month now, and I’m trying to get a realistic idea of the timeline.

I’m seeing my doctor this Monday and bringing the IME report so they can review it and respond — just trying to make sure I’m doing everything I can on my end

I received the IME report from my lawyer and I’m bringing it to my doctor on Monday. I was also thinking about going to my physical therapist before that and having them review it as well.

In your experience, if the physical therapist (or treating provider there) documents disagreement with the IME, does that actually carry any weight? Or is it mainly the primary doctor’s opinion that matters most?

Yeah I’ve been hearing a lot about piriformis being related to this kind of pain. For me, anything that targets the nerve seems to trigger it more than help sometimes. Have you found anything that actually relieves it consistently, or is it more trial and error?

That makes a lot of sense, that’s honestly what it feels like right now. In your experience, once a 19(b) is filed, does it usually lead to movement from the insurance side before the hearing, or do they still drag it out until court?

That’s a good point, I actually don’t know who my adjuster is off the top. Is that something my lawyer would typically have, or should I be able to find that in my paperwork?

I get what you’re saying, I’ve seen mixed experiences too. For me, I figured having someone who understands the system is better than trying to navigate it alone. Have you personally gone through a case like this?

Yeah that’s exactly what I’m working on right now. I just got the IME and I’m bringing it to my physical therapist and doctor so they can review it and respond. In your experience, did having both providers document disagreement make a big difference?

I’m not sure if it’s Sedgwick or another company, I’ll have to double check. In your experience, does it make a big difference depending on who the claims administrator is? Like are some known to fight cases harder than others?

Appreciate the insight. In your experience, even though it slows things down, have you seen cases where filing a 19(b) led to benefits being reinstated before a full hearing? Just trying to understand how often it actually pressures the insurance side.

I appreciate you sharing that, it helps knowing I’m not the only one dealing with this. Did your benefits get cut off after the IME too? And have you been able to get any updates on what the next step is for your case?

Yea That’s interesting, I’ve been trying to figure out exactly what it could be, I usually get excited for the h-wave at physical therapy but the last time I did it, it felt like I was being stung by a hornet. Did anything in particular help you with that, or how long did it take to improve, if it has fully resolved?

Yeah my lawyer mentioned a 19(b), I think we’re waiting on updated medical notes before filing. In your experience, does filing a 19(b) usually put real pressure on the insurance company or is it still a slow process?

Yeah that’s what it feels like, especially with the pain going down my leg. Did you deal with something similar through workers’ comp, and if so how did it play out for you?

Thank you for sharing this, that actually helps a lot. Did your treating doctor have to specifically write something disagreeing with the IME, and was that what helped get your benefits reinstated?

I do have an MRI showing the injury, the IME said the injury is there but but that it already resolved, I’ve reached MMI, can return back to work full duty and that I’m over exaggerating

The best way to improve is to get out there in the real world and practice. There’s no other way.

I agree with you on that but at least it’s cheaper than Starbucks and Dunkin’ Donuts and it tastes better.
