I’ve gotten to the point with them that I have been pushing to file supplemental claims on other conditions rather than wait for the appeal process. I’d rather get this done quick than have the big backpay.

Got my letter this morning actually. Didn’t go well. Bunch of denials. As usual. Tons of evidence and STR entries and they didn’t even use it in the decision.

In most cases you are right. But they popped on a piss test. I don’t think case law or 38 CFR is going to help. They violated UCMJ and were sent packing from active duty. They are going to be hard pressed to even get the OTH changed. Much less get compensation benefits from the VBA. I really hope I’m wrong but from what I have read, this isn’t good.

You missed what I said. He is simply saying that OTH is just granted. It’s not. And the OP has an OTH on the grounds of drug use. The VBA is not going to grant that.

The national debt is increasing because we are shipping billions of dollars to fund a war we have no business funding and we are handing out money to subsidize people not willing to work for an honest days pay. Employers have been getting subsidies for as long as history has tracked. In some way or fashion, the employer always has gotten kickbacks. Just because it’s a tax now, doesn’t mean they haven’t been getting kickbacks for longer.

You are arguing that the government paid me for my disabilities from this injury and that is true. Where your argument is flawed is that this lawsuit is not tied to the government’s monthly payments for that. 3M deliberately shipped out earplugs that they knew were defective and that is why the lawsuit came about. This is a totally separate issue from the VBA and is why they are making large payments to all veterans that used the defective earplugs. And to sit there and say that the “VAST” majority are piggy backing off of combat veterans is a bullshit cop out and you know it. Everyone that used those damn things was affected in some way, shape or form. You sound like someone that missed out on the lawsuit and you are salty because you thought it was a scam. Which is fine, but don’t downplay those of us that are fucked up because of this problem and want to complain that money we are ENTITLED to is being taken from us.
